Mark, You stated that the jury will presume he bought the hemi for the sole purpose of driving fast. This is not the case. Any good 'ole boy (which there are a lot in Tennesse) will know exactly why one buys a Ram Pickup with the Hemi. It's for hauling. Trucks come with the hemi for the horsepower and torque that are needed when hauling items, not going fast. If this were the Magnum or Charger, then you may be right. Get a lawyer John. You have 2 conflicting reports from mechanics. If money is what you want, you won't have to worry about going in front of a Jury, since Dodge & the dealership will be willing to settle real quick. If you want publicity about a bad dealership and no money, then take it to trial. One more thing. Wear your seatbelt!!! You were lucky you didn't die when you were thrown. Just think about your daughter not having a father because you feel you don't need to wear a seatbelt. Or, imagine what would have happened if your daughter followed in your steps and didn't wear a seatbelt! She most likely wouldn't survive getting thrown 15 feet. Good luck John.

Am I correct in assuming that this is a 4x4 truck? You say the axle was still attached but so many people post here using the wrong terminology. I'm interested as my good friend just bought one of those trucks. I don't care how fast you were going, the truck isn't supposed to fly apart. Sounds like somone left some bolts out on the assembly line, but I'd research this truck's history to make sure it wasn't previously wrecked.

Check out my report on Gossett. They also tell me that there is nothing wrong. I take it to someone else and they state that the front end is going out. I do have a lawyer for my case.

Obviously, you'll need to hire an attorney--if one is willing to take the case. However, as Corey pointed out the manufacturer's attorneys (not the dealer's) are likely to discredit your case by hiring experts who will claim excessive speed and/or driver distraction/recklessness caused your accident. Compounding your difficulties is the fact that you purchased the "Hemi" version of the truck and most reasonable people (jury) will assume you bought such a big engine to drive at excessive speeds--otherwise why not get a more normal-sized engine? Plus the car manufacturer has deep pockets. From your brief description it sounds like your vehicle suffered a defect in the steering or tire that the dealership service tech was not able to duplicate the problem. Unless you can find others who have had the same problem you may have a hard time convincing anyone that your accident was anything other than driver negligence, but, then, I'm not an attorney. You can go to the NHTSA website to see if any other complaints have been made about your specific truck. Best of luck!

He could have been going the speed limit and the streets were slick, but he should not be put at fault. There is no reason that the front tire and axle should have came off of a brand new vehicle. He is definitely a victim in this case and you do have a case!!

Have to have been traveling at a high rate of speed for the vehicle to have "flipped" 4 times after making a "slight" turn. Seat belt and weather conditions? I'm glad no one was hurt.
