In March we went to Gossett Motor Cars to purchase a vehicle because we recieved a brochure in the mail about being approved even though we had filed bankrupcty due to cancer of my daughter.

Gabe Reynolds was the salesman that sent these brochures out at least to us. When we went down their to purchase a vehicle we brought all that was ask.

We had just quit J-Mar Express and were planning to start at RSC Trucking the following day. We brought our pay statements from J-Mar and told Gabe Reynolds we did not work there anymore but this would show what we made there and that we would be making .02 more a mile at RSC.

We gave Gabe Reynolds our Visa Check Card Number and he was to take 500.00 that day and we wrote a check for 500.00 to be cashed two weeks later.

The contract was wrote up and we were to be financed thru Amercredit out of Texas. We left with pick up and contract in hand knowing pmt. was to start on 07-02-2004.

Everything seemed to be fine until our temp. plates expired and I called them to fined out why. They said they we having some problems with the bank and would have it straighten out in no time. They sent us a new temp plate for vehicle.

Now my payment is due and I have not rec'd my payment book from Americredit so I call Justin Marshall at Gossett Motor Cars and am told to call Americredit and find out. When I call they tell me they don't even have our account.

I call Justin Marshall back and am told he will check and let me know. We are now back to work and I get a message to call Justin back.

When I phoned him he tells me if it would be alright if we bring the pick up back until they get this problem solved. The problem turned out to be that the salesman Gabe Reynolds turned in our J-Mar pay statements letting the bank think that we were still working there.

So the bank then finds out that we are working for RSC and not J-Mar and that we are lying and jumping from job to job. I phoned D. Gossett and was told I am a liar and that his salesmen would never do such a thing. I have never in all my life been talked to like that.

This man was the most unprofessional and rude human being I have ever had the displeasure to talk to. All he did was yell and talk down to me and would never give me a chance to explain anything.

When I first tried to get a hold of D. Gossett I left a voice message telling him what had happened and how I tried to get a hold of Justin and Gabe on their voice boxes and could not get a reply.

He kept mentioning Breech of Contract because I stated on the voice mail that I thought this was the case. But what all this boils down to is that he wanted us to bring the pick up back which was fine with us but the temp. plate was expired again.

He said it didn't matter and I said it did. We had to drive from Arkansas to Memphis, TN. We told him exactly where the pick up was and left keys in a secure part of the pu and he said he would come and get it and would call us back.

To this day we have heard not one word from him and have not rec'd any of our money back. My husband called yesterday and talked to Justin Marshall about our money and he was told by Justin that D. Gossett was handling this and said he would called D. Gossett and let us know he called.

We went down there in good faith to buy a vehicle instead we have one of the worst nightmares ever. We are not rich people and can't afford to retain an attorney for this and don't know who to go to for help and I am sure D.Gossett knows this.

All we want is our money back which by the way we sent copies of the front and back of the check which they requested to show they had cashed it and still they will not send our money.

We sure could use some HELP.

David from Gosset stated: "Gossett Motor Cars has never received any documentation such as copies of the front and back of the cancelled down payment check so that we can verify it has cleared our account. We will need to have that documentation in order to make any refunds. We have made the decision to refund $500 of the down payment and the other $500 will be forfeited to cover the service, detail and repossession cost of the vehicle." To me that seems that Gosset does not have decent accounting practices if they don't know that a check was cleared through their account. It also seems like the car purchasers got over on the dealer since the dealer is (saying) that they were going to refund $500. Most likely this was a spot purchase gone bad on the dealer's side for once. In general, this transaction sounds like both parties were a little bit to blame. Jacqueline and hubby should not have tried to purchase a vehicle when they were changing jobs the very NEXT day. And it is believable that Gabe Reynolds probably gave them a spot puchase document and filed their current employers pay stubs to get them financed even though he knew they were changing jobs.

Gossett Motor Cars would like to respond to the complaint issued by Jacqueline of Bald Knob, Arkansas U.S.A. We feel her complaint is unfair and misleading in most of its content. Jacqueline and her husband Dale came to Gossett Motor Cars in May of 2004 not March as her complaint states. Gabe Reynolds had sent an invitation to come in and give us a chance to help them purchase a vehicle and re-establish their credit after the bankruptcy. Gabe Reynolds did fill out a credit application on both Jacqueline and Dale and he was given information about the employment. The employment information reflected a short four month job time with both the current and previous employers. We were given a conditional approval to finance the vehicle and so we delivered the 2002 Chevrolet Silverado on May 18, 2004 and sent the finance contract to the lender for funding. The funding department at the lender was conducting its normal practice of verifying information on the credit application and it was discovered that both Jacqueline and Dale had quit their jobs that were indicated as their current employment on the application. This was reason enough for the lender to realize that the applicants would have had three different jobs in a relatively short period of time. With the past credit history and unstable job performance the lender elected to reject the contract and send it back to Gossett Motor Cars. Had Jacqueline and Dale not quit their jobs, the contract most likely would have been accepted and the sale would have gone through. When we could not think of any other way to secure a finance approval we did contact Jacqueline and Dale and asked that they return the vehicle. They made more than one commitment to return the vehicle, but they did not show up as they had stated they would. We contacted them after they had not shown up on one of the times they said they would and they stated they were on the road and could not come in until the following week. This was unacceptable and we were forced to pay two drivers to go and pick up the vehicle in Arkansas and bring it back to Memphis. Jacqueline and Dale had possession of our vehicle for over 60 days and they put 4,601 miles on the odometer. This vehicle had to be re-detailed and serviced when it returned to the dealership. We should not have had to spend money to get our vehicle back and therefore this expense would be paid by Jacqueline and Dale. The detail and service of the vehicle should also be the responsibility of Jacqueline and Dale, not to mention the 4,601 miles and over two months they drove the vehicle. Gossett Motor Cars has never received any documentation such as copies of the front and back of the cancelled down payment check so that we can verify it has cleared our account. We will need to have that documentation in order to make any refunds. We have made the decision to refund $500 of the down payment and the other $500 will be forfeited to cover the service, detail and repossession cost of the vehicle.
