On are about Jan 20, 2008 a Mr Berstein from Graham, Noble and Associates of Buffalo NY called my home and spoke with my daughter. Mr Bernstein identified himself as 'an investigator', with Travis County Texas, and told my daughter that someone was filing a case of fraud against my son Wesley. He would not tell my daughter who are why so she took his number promising to have Wes call; which she did.

Within a few minutes, Wes Returned his call and Mr. Berstein began putting pressure on Wes through insults and the implication that he would be going to jail for fraud with the result of Wes giving Mr. Berstein his bank account information and telling Mr. Berstein that he would speak with me and try to resolve the matter as he did not want to go to jail.

When I learned what he had done, at the insistence of my wife, I instructed Wes to immediately close that account (which he did) even though I could not imagine how Mr. Berstein could get the money out of Wes's account without a signature; I was wrong.

On Jan 30,2008 Mr Berstein's company processed a check showing themselves a signaturee as per Wesley and attempted to withdraw the funds.

On or about Feb 14, 2008, after learning that their withdrawal didn't go through, Mr Berstein again called my home leaving a message for Wes that he would be filing criminal charges with Travis County for "bouncing a check across state lines"; a message I have recorded.

These people are out of control. There are at least two cases pending litigation in both Florida and Alabama for illegal collection practices that I could find, and in the case I found on your web site, a man in Arizona was contacted in Jan of this year by an investigator" and was pressured to again divulge his bank information. But in this case he was unfortunately was not advised to close the account. Graham Noble took the money and when asked for it back told the man "take us to court" and hung up on him.

From research I have done on the Internet and my personal dealings with Graham Noble and Associates, it is my belief that this company routinely practices collection tactics that are clearly against both Federal and State laws.

I intend to make it my mission for a while to see how much trouble I can cause these guys, so I would like to hear from the man in Arizona and anyone else that has information I can use.

GET OFF THE PHONE WITH THEM. WHAT THEY ARE DOING IS ILLEGAL AND IT IS INTENDED TO SCARE YOU only - THEY CANNOT DO WHAT THEY HAVE THREATENED. IT COULD BE A SCAM TOO - there is an ongoing scam using the same tactics but are not collection agencies - just thieves out to steal your money. They usually have heavy accents but make the same threats. This could be a new twist on the scam with a new BOGUS company name. IF it is a legitimate collection agency - they are breaking the law. It exposes all the illegal tricks they use No Collection agency can make threats like that and they cannot just call a demand money or account information. I have the same Michael Bernstein harrassing my husband's elderly mother. He told her that my husband's job is on the line and they know where he works and if they have to go there and personally and drag his butt out they will do so. Who do we report this to? We have not yet spoken to this Bernstein fellow yet. He continues to leave messages on my mother-in-law's machine and other people he knew over 15 yrs ago but has yet to find our own phone number. What can be done?
