Tell us has your experience with this business or person been good? What's this?
My husband and I bought our 1993 mobile home 11 years ago and it was financed through Bank Of America, then they were bought out.

Greenpoint became our new creditors, and granted we were late many many times with our payments, we were harrassed over and over again.

I actually was asked "Can't you borrow the money to pay this bill?"

I was called all hours of the day and night, even after 11pm, and on Sundays, and occasionally on Holidays.

At one point, we had gotten an extension on our loan, and then stopped recieving bills, or bills with 0 due now on them.

Now at this time I was in college fulltime, working and trying to raise four boys. I hadn't paid too much attention to the fact that our bills were still showing $0.00 due, and when I did notice it and thought it odd, I thought well maybe we got a longer extension than I thought!

Well, come to find out when I called about said discrepancy, I was told I was over due by $2100.00. I paid $1100.00 and they extended the rest(which means they just add it on to the end of the loan), which I thought they should have eaten seeing as it was their error to begin with.

Well eventually, I got tired of hasseling with them, of making payments on a pitfully built mobile home (that was literally falling down around us).

I mean the walls literally buckled in the middle, the roof started leaking, we had water lines leak from almost day one, a sliding glass door that leaked, particle board floors that were rotting through, shattered windows, had to replace the front door due to buckling, the vent over the stove kept falling no matter how we tried to put it back up, we found out there actually was no floor under our tub in the front bathroom and suspect the same is true in the other bathroom, we found out that there were 2X2's in the walls, and the supporting beams in the floor were only 2x4's..... but of course this is manufactoring not financing.

But it goes to show why after 10 years of living in this mobile home I decided I had had enough. so I called Greentree (they had just "bought" Greenpoint) and told them they could come get the mobile home. That I simply wasnt going to make another payment on it!

That was in December 2004, now it is almost July 2005 and the mobile home has been empty since December and it is still sitting on my father in laws property.

Then I just recieved a notice from a collection agency that stated they need to recieve a 24,000 dollar payment immediately.

I am sorry, but I wouldnt allow my worst enemy live in that house, let alone my only family. And I refuse to pay for a trash heap. I just wish they would come get it!

And I wish they could reimburse the many families that they have told "obviously you dont care about your home"

I actually was told that, that I didnt care about the obligation to pay my bills, and that I didnt care about my home. While trying to explain to the man about my sick children and why I hadnt been to work, I was yelled at, cussed at and then in his computer he claimed I had cussed him out. Sheeeee... I told him to go to He-- and hung up in his face!

Can anyone tell what the law is? Shouldnt they have come and repossessed this home by now?

if i were you id have your father in law to send them a certified letter(if he can afford to do so get a lawyer to write it up)tell them they have x amount of days to remove the mobile home from his property or it will be impounded.let them pay the impound fees.you have the right to evict it from your property.if they continue to call you sue their butts for harassment.also charge them rent for every day the mobile home was on your property after their time runs out. my sister had a mobile home financed from greentree/greenpoint on my property and we are currently going through the same ordeal.rude late night or early morning calls, threats and accusing me of lying about her death.i wouldnt want my worst enemy to live in the mobile home she had much less keep it.perhaps the employees that defend them should have to deal with them for awhile.

So where's the problem? shoddy construction and workmanship

You complain about the shoddy construction and workmanship on a mobile home, and refuse to pay the financier for it? That's fighting the wrong people. Any complaint you have is with the manufacturer/dealer, not with the finance company. The finance company cares about one thing, getting their money. You signed documents saying you would pay them in a timely manner (Which you admit you have not done). It doesn't matter what happens to the home, what is wrong with the home, you owe them that money. Now, you move on to basically a voluntary reposession, but yet you state the home isn't fit for habitation. Normally, they would reposess it and then resell it, and you would owe them the difference between the payoff amount of your loan and the selling price. However, since it's not fit for habitation, it's obviously not sellable, therefore, you owe them the difference between your payoff amount and the selling price ($0). While there are laws about the times that they can call you, you're still on the hook for the payoff amount of the loan. As for late fees, etc. That I am not certain about. If you buy a brand new car and the car is a lemon, you go back to the dealer, you don't refuse to make payments to the finance company. This is no different than had a tornado hit the trailer and destroyed it. If you had no insurance, then you don't escape paying for it. You're paying for something you don't have. As for being harassed, what constitutes harassment? Someone calling asking you to pay the money you owe? You are responsible for making sure your payments are sent on time. Since you think the finance company should have eaten the $1000 for their mistake, how much should you have eaten for your "mistake" of not paying the bill? They seem to have done the right thing to correct their mistake by allowing you to pay part and adding the rest on to the end, rather than saying "Pay it all now", which technially would have been their right to do, but wouldn't have been the right thing to do. Outside of the late night calls, if true, the finance company has done nothing wrong here. The law is that you are eventually either going to pay the amount due, or they're going to sue you and win a judgement against you. Of course, you could sue them for the late night calls, assuming you have proof, and after lawyer fees and time at court, you'll walk away with a couple of hundred dollars... Which will probably be applied to your $24,000 balance.
