Dear Evan Michaels and In Demand Talent,

Please find attached relevenat documents and emails pertaining to the agreement between In Demand Talent and HK Entertainment Limited on the 3rd of September 2009 for the artist deposit required to book artist Radiohead to play a gig in Hong Kong.

According to the Talent Broker Engagement Memorandum, the 69,000 USD sent to In Demand Talent is the artist deposit and NOT the Talent Broker Engagement Fee, since there was no date availability/confirmation from the artist.

Therefore we expect to receive the 69,000 USD artist deposit back.

We have been emailing/telephoning/faxing however have received no response yet.

If you do not comply with our request, you will leave us no other option but to reclaim what we are entitled to through legal action.

Interestingly enough, we would be more than happy to have direct contact with you Mr. Michaels so that we can resolve this matter professionally, however this "garbage" website seems to be the only way for us to receive a modicum of response  from you. We have made telephone calls, left voice messages, sent emails and faxes, all with no response.

We are well aware of what is stated in Term 1, "...payable on confirmation of Date availability and basic Artist Fee."

How then, would the artist deposit/security binder meant for holding the artist we sent to In Demand Talent be construed as the Talent Broker Fee, when the reason that the gig did not happen was because the Artist had NO DATE AVAILABILITY and thus NO TALENT WAS BROKERED? Term 1 clearly states that the the Talent Broker Fee, is payable only upon a confirmation of BOTH Date availability of Artist and basic Artist Fee.

Regarding your mention of Savio, the artist deposit/security binder was sent to IDT and not Savio, in an email between Savio and yourself dated Wed, Sep 30, 2009 you even stated that the money sent to you was "Binder was collected for security purposes," and in the same email you stated that "The Radiohead binder would be used as a credit towards the event, and your investors could decompress knowing their money is reinvested into a new show that is confirmed." So again you have stated that the money sent was a artist deposit/security binder and not a talent broker fee and that the original Radiohead show that the artist deposit/security binder was for was NOT confirmed.

This is obvious and irrefutable proof that the money sent to you was NOT a talent broker fee but a Artist Deposit or as you like to call it a Security Binder. As such the full amount of US$ 69,000 should be returned to H.K Entertainment Ltd.

AMR1972, thank you for your copy and pasted input, but it would be great if you would refrain from posting when you don't know what is going on. We did not renege or change our mind, had you bothered to actually read our report you would see that the Artist we were looking to hire was not available on the dates requested.

We are simply seeking that the Artist Deposit/Security Binder that we sent be rightfully returned to us since the Artist was unavailable, and I'm sure if you have really worked with IDT for 5 years and have "READ THE CONTRACT!" as you so duly advise us to, you would realize that it is stated clearly in Term 1 of the contract, a talent broker fee is only payable upon confirmation of BOTH Date availability of Artist and basic Artist Fee. Clearly in this case there was no confirmation of date availability for the Artist.

We have all the emails and documents proving everything that we have said is true.

We are NOT interested in booking another Artist with the Artist Deposit/Security Binder.

We sincerely hope that as one professional to another, Mr. Evan Michaels and IDT can resolve this matter in the only way it should be resolved by returning the artist deposit/security binder of US$ 69,000 to H.K Entertainment Ltd.

We would truly prefer not to have to take legal action and waste further time and resources of both In Demand Talent and H.K. Entertainment Ltd in what is clearly a very straightforward matter. We look forward to receiving your prompt and professional response, In Demand Talent and Mr. Michaels.

We have worked with IDT for over 5 years, Mr. Michaels has been our buyer for just as long. Not only has this company helped to book some of the biggest names in the business, but they have been forthcoming about their policies, and always held up to their word! I find it outrageous that websites like these can exist, giving fraudulant or unsatisfied customers the ability to affect potential clients' opinions by slandering and making false claims. IDT has always come through for us, these claims are ridiculous. READ THE CONTRACT! If you don't like the terms, find another company! The policies were there before you signed on, and they are fair. Should we have a broker negotiate a contract for us, and we reneg, that would affect the broker's relationship with his contacts. Why should they suffer for doing their due diligence, because you change your mind for whatever reason. They get paid for their work! It is quite obvious that the policies are there to protect both IDT and artists, as well as us as clients. I am sure had these people held up to their end of their contracts, they would have had successful events. DO NOT BLAME EVAN MICHAELS or IDT!!!

Interestingly enough, this is the same complaint! We have multiple contracts from this person, who hired Savio, gave him money, anddddddd was unhappy with his services, so they attack IDT. Contracts clearly state in term 1 how the broker's fee is treated. We are happy to book another artist and fulfill this contract, yet we have not been contacted in almost 2 years! I suggest direct contact to resolve this rather than complaining on a garbage website that should not exist, and is unfair to good business practice!
