Earlier this year (2008) we were in the market for a new a/c system and believing Home Depot's advertising that they Guarantee and "back" all work and installation services they offer, we went to our local Home Depot store here in The Woodlands, Tx. on a Saturday and found their Trane A/C systems Desk where we filled in a card/questionaire that we wanted Home Depot's Trane installer to contact us for an estimate.

The following Monday we received a call from Guy's A/C & Heating in New Caney, Tx. (about 25-30 miles away) telling us they were given our name and number from Home Depot.

Guy's set up an appointment to come to our home and evaluate our needs and leave us with an estimate. The Guy's salesman came to our home a couple of days later wearing a Home Depot shirt and gave us a Home Depot brochure on the Trane equipment and left us with a Home Depot business card with Guy's A/C name on it also.

Skipping a lot of the details from that day forward, the bottom line is that we eventually signed a "contract" to purchase a Trane a/c system and have it installed.

On the day of installation when the job was (allegedly) completed, we paid the lead installation man $6,170.00 (in "green" cash from our meager retirement funds) as we do not have a checking account.

A few weeks after the install we received a Home Depot Thank You card by mail that was mailed from Guy's and not from Home Depot. Other things that happened after the installation caused us to gradually become suspicious about whether Home Depot even knew of our purchase and thus, whether we were in a "contract" with Home Depot's name & reputation to back it up (as we intended from the day we walked into our Home Depot store and filled out their questionaire at the Trane desk) or whether Guy's had very cleverly deceived us into believing that we had a "contract" with Home Depot when, in fact, our "contract" was with an independant, East Texas a/c contractor whom we had never heard of and who had NO public reputation to speak of.

Well, our suspicions turned out to be true....after many phone calls, and a few emails, Home Depot has gone from a position of, "don' worry, we will make good on anything done by Guy's", to "don't worry, this will not cost you one more dime", to the Final position written in a "certified" letter that states, "You have NO contract with Home Depot".

We are shocked. The bottom line for us right now is that we paid $6,170.00 (in cash) for a "Contract" with Home Depot (for our new a/c system) and we've been "Defrauded" out of it by Home Depot's own "agent" with Home Depot's help.

We want to sue Home Depot and their Trane License Holder and Guy's A/c of New Caney Texas.

In response to Shopgirl Spring, Texas ripoff report #350189 regarding their experience with Guy's Air-Conditioning & Heating, I feel it necessary to express our side of the story with regards to the customer purchasing an air conditioning & heating system.  Our salesman at the time did in fact receive the customer's information from our greeter at Home Depot located in The Woodlands with no prospect # being assigned and made contact with the customer to bid an air-conditioning and heating system for their home.  The customer asked for and received certificates of our general liability, business auto, and workmen's compensation insurance.

With regards to the "contract signed", the customer signed a Guy's Air-Conditioning & Heating proposal accepting the bid to install a Trane 5 ton 15 seer complete system.  Upon completion of the installation our lead installer presented a Guy's Air-Conditioning & Heating invoice for the completed installation and asked the customer at this time if they would be financing through Home Depot, and the customer answered no, that they were paying cash for the installation, and proceeded to give the invoice amount of $6170.50 to the lead installer.

The customer states they were deceived into thinking that they were in a contract with Home Depot, and in fact NO Home Depot paperwork was ever completed or asked for by the customer in regards to the installation.  All paperwork signed and accepted by the customer was Guy's Air-Conditioning & Heating paperwork.  Unfortunately, by the time of the installation, the salesman that had completed the proposal on our Guy's Air-Conditioning & Heating proposal had left the company.  Guy's Air-Conditioning & Heating, being in business for over 30 years, offers all customers that purchase equipment from our company a full one (1) year warranty from the date of the installation.  This warranty covers all parts and labor regardless of what the problem is, part failure, workmanshp, we are there to take care of the problem.  An additional 10 year extended warranty was also purchased at the company's expense to cover the system installed at the customer's home.

At this time there have been no reports or requests from the customer with regards to problems or issues with the Trane system that has been installed for over a year now. 

Guy's Air-Conditioning & Heating has been in business for over 30 years, and has earned the reputation of taking care of our customers after the sale.  Guy's did not set out nor did we defraud the customer in any way.
