9/04/09 - Home depot add paper included a vinyl fence panels measuring 5 1/2 feet high and 6ft wide at a price of approximately 49.99 with the caption "Ask about instillation!!!" The sale was to last that weekend only.

9/06/09 - My wife an I went to home depot, inquired about the fence and installation. For installation we were informed it would be directed to a 3rd party installer which would call us back after entering our name into the computer list.  When asked about "What about the price if the estimate can't be scheduled by them for a few days?" I was informed that, because we had already come down and set up an estimate appointment, the price would be locked tot he sale price.
The name tag of the associate is spoke with said "James"

9/16/09 - The estimator came and surveyed our yard. When inquiring me as to what fence we were wanting we found the price in his book at $168 per panel instead of the advertised $49.99.  I informed him we had locked in the weekend sale price. He informed me that the panel and pricing I'm describing cannot be matched by his instillation company.

9/16/09 - After the estimator left I returned to home depot.  There I spoke with customer service rep. "Tony", assistant manager "Cat" or "Kat", and again "James".  After spending 2 hours at the store location they informed me it was an add error.  That the fencing is neither offered at that price nor is that particular fence offered for install.  "Kat" had asked me to leave my contact information so they may try to resolve the matter with their contractor.

9/18/09 - Placing a follow-up call to the store I spoke again with "Kat."  She informed me that they were unable to negotiate an install with the contractor.  She also informed me they would not honor the add price on that fence.

I feel I have been subjected to false advertising in an attempt by home depot to conduct a "Bait-and-switch" on me.  
False advertising: Advertising a service they refuse to or cannot provide.
False Advertising: Advertising a product they refuse to or cannot provide for the stated price.
Bait and Switch: Contractor represented by Home Depot offered comparable fencing at over three times the advertised price.
