The latest harassment/mental anguish i have encountered from HomEq is almost ancient history in the scope of what it usually is from them. But it was in April 2008 that i will start with.

Upon returning home from working out of state in April of this year. Stuck to my door was a notice of foreclosure , at the foot a overnight letter. The foreclosure which had a fax time stamped date of Sunday March 30, 2008. Inside the overnight parcel was the two checks I had sent HomEq on aprox. the 10th to 15th of March 2008. I sent my Jan. & Feb. 2008 payment on one check and the March 08 then monthly due payment on a separate check, together in regular mail. On the back of the checks HomEq has stamped "received March 31 2008"

Right away I assumed they doctored up things. The fax sent on a sunday? Legal documents! Sunday. And my checks the following day Monday the 31st.

With HomEq anyone involved with them eventually must consider the worst and expect nothing less. I also figured my checks were received then held until the last possible day preventing any possibilities of me getting a cash payment returned back before months end.

I must include the checks were never submitted for payment! Just received held and returned. Right away I called them. After 2 transfers and a hang up I spoke with a male representative "of whom i have written down in my notes" that insisted that my December 08 payment was also absent. After providing proof of check # and the bank's name the check was literally drawn from. He went on to say that as of the 1st day in march my account was deemed 3-months late. And the foreclosure papers were filed. I have a monthly grace period, then further a date of the 16th before late fees can be applied. And not until the following completed month late can my payment be reported to credit reporting services.

But yet only 2 complete months had passed, in the 3rd month they admit receiving my checks. And began foreclosure process.

Immediately as possible i spoke to and set up a repayment. Of which included $2300. additional dollars for legal fees. I then returned payment to them again the amount was sufficient to bring my regular monthly payments to date. But the additional $2300. had remained to keep them reporting my monthly mortgage in default to credit agencies.

I made a complaint to the "Comptroller of the Currency Administrator of National Banks". There supposed to be a sort of consumer protection agency . But it really like complaining to a low level bank employee. Seeing how they are paid and formed by the banks they oversee.

The complaint went to Wachovia the ones who bought my note from Decision One. After many months and me paying up all there assessed legal fees. I received the return letter responding to my complaint.

Wachovia's response was they had no information about the matter in hand due to HomEq was sold to Barclays Capital on Nov. 1, 2006 and the completion of the merger was on April 1, 2007. Therefore, the bank Wachovia stated they are unable to research or respond to the issue concerning my mortgage.

In July of 2007 the 31st after being as well in a repayment agreement with HomEq . I made a payment over the phone they accepted. unbenounced to me it brought my account within $50 dollars of being completely caught up. Only to be served foreclosure papers just 4 days later again. Therefor creating the position where they wouldn't accept any payments.

That got drug into the following month. Eventually being reversed as a foreclosure . And taking me until Nov. 30, 2007 to finally again catch up. As you figure my mortgage payment status was being reported delinquent through the year.

I have been foreclosed 5 times in 4 years. They are absolutely the worst most rude people imaginable to deal with. As though none of them have ever been late or behind financially in there life. They must get some bonus according to the amount of foreclosures they successfully process. Who knows ? If anybody ex-employee of there's does pleas come forward weather you feel toy are familiar with a case or not. I'm sure there's hell to pay you fear from them, But the hell that the people face that have to deal with HomEq is nothing by comparison.

I Have to believe a day will come for them! There is no way they pay there employee's enough that someday one will get fired and end up talking. Who knows ? Hopefully some employees relative or ex-employee "FIRED" employee will wind up on the wrong end of the phone hearing the same sounds of SATIN as the rest of us.
