I'm sorry that you may not understand the problem here. Block offers a Refund Anticipation Loan (RAL), as do most tax preparation companies. But the tax preparer does not determine credit worthiness. The application is filed with HSBC Bank, who then reviews your credit report, and determines if you are eligible for the loan based on a number of factors. I do not know why you were denied the loan, but it is not a Block decision, nor can your tax preparer guarantee you will qualify. Remember this is a loan, so the bank is advancing your refund to you, and charging a finance fee as well as interest. When a RAL is denied, the application automatically reverts to a Refund Anticipation Check (RAC), which is not a loan, but rather the bank providing you a check after the IRS transfers the money to them. Your RAL fee is reduced because you are no longer paying interest on a loan, but only a bank process fee (convenience charge). Therefore your refund will be larger than quoted for the RAL. Because the bank has to wait for the IRS to release the funds, there is a delay in getting back your money. While the print is small and covers four pages, most people do not read the application, which explains what happens in the event a loan is denied. As for purchasing a Peace of Mind (POM)Guarantee, which you said was not honored, I do not know what the circumstances were in your case. However, the Guarantee states that Block will pay penalty and interest, plus up to $5,000 of any taxes you owe, if the IRS finds an error or changes its interpetation the law. It does not cover mis-stated information (ie., claiming a dependent that is not yours) or omission (ie., not providing a W-2 or 1099). The most common problem occurring in which Block will not pay under the POM are tax payers misrepresenting their income or not being able to provide documentation on self-employment claims or schedule A forms. People incorrectly claiming dependents for Earned Income Tax Credit are also a common problem that the taxpayer is responsible for. Again I do not know the circumstances in your case, but I hope my comments may explain the two situations you described.
