May 2007 I contracted with Internet Marketing Images to develop a real estate website from beginning to end. They immediately charged my credit card $2,850 to develop the site, with another $2,850 due upon completion. Also at completion $375 would be paid for 4 months for Search Engine Optimization of the site, $30 for website hosting, and $50 for a third party real estate (IDX) search engine.

August 2007 The company launched the site and charged my credit card the second $2,850. The site was not complete, and has never been completed. I tried to work with Dan Stalfire at SEO ONE (Their 'sister' company who actually charged my accound) and he continuously made excuses, but never followed through with the site completion. I was never given a copy of the site, and have absolutely nothing to show for the money charged. Also charged was $375 and $80 multiple times as per the contract...however without a complete site these charges should never have happened.

In December I called Discover, my credit card company, and disputed the charges, which SEO ONE defended with the contract. Discover is currently enforcing the charges on my account with interest. The only charge I ever did authorize is the first $2,850. I have repeatedly tried to dispute the charges with Discover since then.

I was told by (I believe it was the vice president of SEO ONE) that the programmer who was working on my site was fired.

I do not believe the company has the ability to deliver the product as promised at this point.

Regardless, the second $2,850 comleted development charge and the multiple $375, $80, and $30 charges should never have occurred.

The company is in breech of contract, has used ridiculously unfair business practices with me, has fraudently used my credit card without authorization.

Below are all of the charges that occurred.

$2,850 x 2

$375 x 5

$80 x 2

$30 x 3

Matt Lewis of Sky Sotheby's 3rd attempt to slander of name

#2REBUTTAL Owner of company

Fri, September 12, 2008

Matt Lewis of Sky Sotheby's in Florida did in fact hire our web design and marketing firm to build him a new web site and to market the site to the search engines. After working closely with Matt we created a beautiful new site, fully optimized and ready to be submitted to the search engines. We obtained permission from Matt to go live with the completed site and began the internet marketing phase of the web site. The web site was site mapped, and submitted to all the major search engines each month as per our agreement. Matt then decided that the site was not complete due to a module that he wanted added. What I have explained to Mr. Lewis is that I have attempted to contact the vendor with the add on application numerous times, and that I cannot hold the hand of a third party vendor and get him to send me the information I need. I did what I was hired to do. 1. We built a beautiful, easy to navigate web site for Matt. 2. We optimized the web site and scored each page in the 90th percentile for SEO. 3. We were given permission from Matt Lewis to go live with the site. As per our agreement, once the site goes live the final payment is due. To catch Matt in a lie he said I was never given a copy of the site, and have absolutely nothing to show for the money charged. The site was put live and was fully functional online. The site is no longer up due to non paying of the hosting, however www.archive.org recorded an online copy at the below link. Archive.org will store all live web sites, not the images but it still shows proof the site was online! http://web.archive.org/web/20071114165030/http://gulfandbay.com/ Matt has now filed a credit card charge back and Discover card has agreed with us that we did our job and deserved to be paid. Matt has issued demand letters, and now he is trying to slander our good name. Enough is enough, we did our job and we earned our money. What more do we need to do?
