James Fagan of J Fagan Const. Inc. did a horrible job on a retaining wall installation, sod and sodding installation and sloping my yard for drainage. He says the job is done but I still have puddles, potholes and high spots in my yard. Sod was laid over uneven soil and the wall he installed is "wavy" where it is supposed to be either gently curved or straight. I would have liked either of those but not wavy. He assures me that he did the job I paid for. I thought the soil would be smoothed out before the sod was laid. Watch out for the little details.

Under bid!?!?!?

James Fagan went over 40% on a construction job on my families home and harassed us to try to get the money. He is great at his best, but rude and unprofessional when you question him. I am glad to see someone got treated well by Fagan Construction Inc, but please know that he has a questionable background at best.

Arkansas has been flooded several times this year. I have hired J Fagan constr. company for several times and have never but received top notch workman ship. They have even come under bid. If I hired a contractor to build me a house and a torando came agone and it was gone, the next day, should he build me another one? I came across this site because I was trying to find their web site and could not believe what I saw. This person, with all the rain and flash floods we have had this year, must be trying to rip off this contractor because be paid for something that mother nature washed away. Sorry stuff just happens in life.

J Fagan Construction of Little Rock, AR Pulls out of Arbitration by BBB

Mr Fagan had agreed to arbitrate through the BBB but after receiving the documentation that I had to prove my case he pulled out because he felt his time would be better spent "doing business" with other customers. Please check this web site for pictures of his work. http://sites.google.com/site/badlandscapejob/ More pictures to be added soon.

J Fagan Construction Rebuttal to Ripoff

#5Author of original report

Mon, July 14, 2008

I never agreed to have my yard left in the condition it is in. The proper slope of the yard that was discussed was not even attempted. The yard slopes toward the house and deck and standing water at the foundation is still a problem. Our only discussion of changes to the contract was the position of the wall. At any price the job should be done RIGHT. Proper care of new sod is frequent watering and the slope away from the drain he installed renders it useless for most of the yard. The fact that there was no preperation of the compacted soil has left holes and the rocks and uneven soil left on the ground has caused humps and low spots resulting in puddles. Clearly Mr Fagan has little experience installing sod and straight block walls and no one would ever agree to have their yard left as he left mine. There is no clear detail in the pics of the before and after on his web site. Pictures can be found at (http://sites.google.com/site/badlandscapejob/Home) with more to follow.

Keith : customer trying to get something for nothing!

#6REBUTTAL Owner of company

Mon, June 30, 2008

Keith was given an estimate for $6,428.50. He then requested additional work to be added to the job therefore resulting in a higher estimate of $9,124.06. Then he decided he could not afford this and to do something for around $7,000.00 to $7,500.00. The necessary changes were made to achieve his request, which Mr. J agreed to. Upon completion of the job Mr. Jo was given an invoice for $7,369.13 and in turn he insisted that I do the work before the changes he requested. At that time I agreed to do the work but reminded him that the bill would then be $9,124.06 as the estimate stated. Mr. J threatened that if I did not do the extra work for free he would resort to other measures. Mr. J filed a complaint with the Better Business Bureau who closed the case stating "In the judgment of the Better Business Bureau, your company has made a good faith effort in an attempt to resolve this issue; therefore we are closing the case at this time." He has now filed a complaint with the Attorney General's office which we are waiting to hear the outcome. Mr J has contacted our venders on numerous occasions. Each time they contact us to let us know of his annoying inquiries. Now he has put this inaccurate report on us. Mr. J can continue to harass us all he wants but it is not going to change the fact that he wants something for nothing, besides if his job looked so bad why would we put it on our web site on the Before & After page (Retaining Wall). jfaganconst.com We have always stood behind our work and will continue to do so. Keith, as I stated before quit pulling up the grass and watering your yard every 2 hours and you won't have those puddles. Give the grass a chance to root. As for the actual retaining wall the pictures on our web site speak for themselves.
