JAM Enterprises never shipped the PACE model #779x DVR I ordered 7/28/2103 after I paid them $130.00 from my checking account on July 30, 2013. An over the phone ACH payment authorization was asked for by “Jay” so I would get the “wholesale price,” which was a substantial discount, but in doing this I lost my ability to challenge the sale through my credit card company. JAM Enterprises created a shipping label on www.UPS.com on 8/15/2013, making me think it was shipped, but tracking information did not appear on the UPS website, so after 6 days I cancelled the order. After emailing and speaking by phone with "Jay" at JAM Enterprises, on 8/21/2013, he agreed verbally and confirmed in an email to refund $110 of my $130, charging a “restocking fee” for an item that was never taken out of stock or shipped. Clicking on the UPS tracking # shows JAM cancelled the shipment label on 8/21/2013 and that UPS never had the merchandise in their possession.  Now six weeks later, JAM has not issued a refund check, long after the 15 business days they state in their “Warranties and Disclaimers” posted on their website. They no longer answer their phones when I call. The last I heard from them was on 9/25/2013, when they asked me to once again explain why I asked for a refund, saying this information was necessary for their records. This was their response to my demand they follow through on the refund. Since that date they have not answered several emails from me asking again that they follow through with a refund. And in not answering phone calls from me, they have cut me off completely.  Apparently they believe they can keep my money without my being able to recover it through any means. This is clearly fraud on their part and I would appreciate any help anyone can give me, not only to recover my $130.00 but more importantly to protect other consumers from this scheme. Jay told me over the phone he had sold 16,000 DVR units in the past year, and if this is true this is a large scale consumer fraud operation.  They have dozens of complaints they have not responded to at the local BBB, going back to 2011. How can we let this continue? This is worse for me because I am a senior and a trusting person. Jay was a very smooth operator on the phone, carefully answering any concerns I had about his products and my order, but not letting me know this was not “just about saving money” but really “just about being brazenly stolen from.”
