You are crazy if you don't. The amount of money you spend on that stop payment will be worth the amount of crap you will have stopped from happening. They did give you a line of BULLSHIT about fees, blah blah. Today is the 2/4. They will hound you for the balannce owed and tack on interest every month! What you have done by paying anything on the check is RE-AGED your debt. They cannot file any lawsuit or disturb your credit report for acheck that is 9 years old. Check your state's Statute of Limitations. Odds are, the check is way beyond it. You also may have already paid it! It's not on your credit report for a variety of reasons, probably most importantly that its beyond SOL. By paying anything, they can NOW disturb your credit and force you to pay it or wreck your credit. They will now have NEW TIME to chase you for the debt, and sell it to someone else if you don't pay up. Go to your bank NOW and tell them there was a fraud forced upon you. If they don't want to help, go during lunch when you know it will be busy and say very loudly "You are going to allow someone to committ a felony on me and won't help?" Make a stink and you should get your way. I don't mean this derogatively against you, but you must get educated on the laws in your state regarding debts and collection. These collection agencies are profitable because they are counting on you not knowing your rights. Don't ever give any information over the phone or through the mail before they have proven that the debt is valid. Do your research on any company that contacts you 9 years later. But be aware that it is legal to collect on a out-of-SOL debt. It is NOT legal to harrass, lie, intimidate, scream or committ fraud to collect it. Also get a cease and dessist letter off this website and send it return signature required ASAP. When they learn you put a stop payment on that check, they will call and harrass you over and over. First of all, you should have demanded they fax, or mail, you a copy of this supposed check! The burden of proof was theirs to bear; consumers are just not aware of their rights and creditors take advantage of this! I would get ahold of them anyway and demand they provide you with a copy of this check. If they cannot, I would take them to small claims court and sue them for $1,000. That is the amount you are entitled to due to them harassing you, terrorizing you and BREAKING THE LAW! This is copied directly from the Fair Debt COllection Practices act, which can be found at the link provided. What a debt collector may NOT do: "threaten actions, such as a lawsuit, will be taken against you, when such action legally may not be taken, or when they do not intend to take such action".
