I recently purchased a vehicle from JD Byrider on 6/17/2011. I made gave the sales representative $195.00 on 6/18/2011 and made a payment of $150 on the next Friday. Then I paid $150.00 every other week. Never missing a payment and complying with the agreement.

On 07/02/2011 the car a 2002 Saturn SL2 began to make a strange noise. I checked the oil and put in 2 qts. After that it really began to make a lot of noise. I took it in to JD Byrider and they said it needed a new engine. I could not rent a car because I have do not have a credit card and lost my job due to the fact that this car broke down. I was to start a new job on 7/12/2011 in which Steven Williams promised it would be finished. Now it is not going to be finished until 7/13/2011. The date keeps changing.

To make matter worse a woman named Kristi calls from CNAC the finance company being completely rude saying that I owe the payment and that I am in default of the loan. I could not even pick up my check from my last job in order to pay CNAC. Then she ask if I can borrow the money from a friend or family member. What?

They would have had their money if they had not sold me a faulty product! This engine had to be bad when they sold it to me. This is unexceptable! Now I am out of a car and they expect payment for a bad product. Now I am waiting for them to fix the car so that I do not loose another job. What am I to do?

I don't really think you meant what you said about it being "UNEXCEPTABLE" as that does not apply to your situation as you described it. Just so we are on the same page, the word "unexceptable" is generally used in context of insurance or legal exceptions. If something is "unexceptable" that means it can not be excluded.  Look it up for a better definition.

I believe the word you are looking for is "unacceptable" which means you won't tolerate the situation.

However, you put yourself into this problem by purchasing a vehicle when you clearly can't afford it. Based on your description of your payment plan, you were in over your head right from day one. This puts a lot of stress on you to make the payments for the vehicle AND pay for the repairs. When you are tight for funds, its better to not take on that responsibility.

It is not the responsiblity of the lender that financed your car to pay for repairs too. That is your responsibility.

What to do? Short term: Make sure you bring in enough funds to make the payment and pay for the repairs. You are in a bad spot as I'm sure the vehicle is upside down in value. Get an emergency account put together. Work at least two jobs so you can pull yourself out of this situation. Once you pay off this vehicle, don't get a loan again. Buy one for cash so you won't have this extra stress.

For the long term: work on your credit and your education. You would be surprised at how life becomes easier when you take responsibility for your decisions and your actions.

- Ummm that is not saying much, because that would mean you have made a total of 3 payments(6/18,6/24,7/8).  But even that is misleading because the "Then I paid $150.00 every other week", would have been only the ONE payment on 7/8.  Had you "never missed a payment" they would NOT be calling you for a payment because you would be current and your next payment would not be due until 7/22.

You do not appear to complain about having to buy a new engine, so are they replacing it at no cost?  If so you should be happy because unless you had some sort of warranty with them, they would be under NO obligation to do so.  If it truly does require a new engine, you would be looking at a few thousand dollars in repairs.

However it is NOT their fault that you don't have a credit card.  For the same reason you don't have one is probably the same reason you had to go with a sub-prime lender.  By your past credit history you have not shown you can handle credit.  It is also not their fault that you lost your job.  Because it is hard to believe that there was not a single relative, co-worker, or friend who could not take you to work.  Even if you didn't have anyone who could there is public transportation.

It is also not their fault that you can't pick up your last paycheck.  If you are seriously stranded where you can't pick it up why can't they mail it?

It just seems that you are trying to find every excuse in the book as to why you shouldn't pay them,  but know that having a car repaired does not give you a "pass" on making your payments.
