Mr. Pearson took payment from me for J-1 waiver physician employment search services, but then would not sign a contract despite my repeated requests, likely because he did not intend to provide the service in the first place. Mr. Pearson only recently responded, justifying withholding a signed contract, saying, The contract is for my protection. If you purchase a car and you sign a purchase of sale-you bought the car. Mr. Pearson chose a fitting comparison a car salesman. He also did not provide the employment search services that he claimed he would provide, which led directly to my missing medical employment opportunities for a full year. The only way I could remain in the U.S. after missing the work visa waiver application deadline of October 1 was to further my training. I had not sought other employment as I had expected Mr. Pearson to sign the contract and provide the job search service after I sent him the check. Pearson also sent a list of his supposed customers but this is actually a list of customers of his previous employer, not clients of Jeff Pearson Consulting. Mr. Pearson simply wanted the deposit, and did not want to live up to the terms of any contract, as he did not intend to provide the service in the first place.

Mr. Pearson Did Not Identify any Suitable Positions

Mr. Pearson also states that he would "'identify' suitable practices/positions" and then claims that I never accepted the positions he offered he never offered any positions in any of the locations we had discussed, where he promised positions were available. He had claimed in conversations that it would be simple for him to arrange for interviews in places like Phoenix (where he said he could arrange jobs "all day and all night") and Virginia he never arranged for interviews (See the enclosed email messages). He claimed to be able to arrange a position in rural Massachusetts, but when I took the time off training to travel there, no interview had been arranged and no position was available! After taking my check, the only other position Pearson claimed he could arrange was one in Baton Rouge, Louisiana, a location that was clearly not suitable (At the outset, we had made clear that we needed to find a location where my spouse could also work, which meant being near a major city) and was not one of the 10 or 15 places we had discussed as possibilities the position in Louisiana, post-Katrina, was advertised throughout all the medical publications and websites and I even received a direct mailing for it no one would need a recruiting consultant to find this position!

Background:

Pearson promised he could easily arrange interviews in Arizona, Texas, Virginia, Massachusetts, and Maryland. He NEVER offered interviews in ANY of these locations. He only ever offered an interview in Baton Rouge, Louisiana -- that's it -- a location that I had never expressed interest in. More recently, Jeff Pearson suggested that I my country is more needy of physicians than is the U.S. "Of course, [your country] needs physicians "much more" than the US currently as well" and that "there are a lot more needy, poor people in Louisiana, [your country], and other places than there are in Phoenix, New York or Connecticut." It doesn't seem he ever intended to find positions in those locations and perhaps expected me to return to my country of origin.

Jeff Pearson responded to my request for a refund: 'A criminal lawyer does not return money collected from his client because the client is convicted of an offence." Mr. Pearson chose a strange comparison, a criminal lawyer I thought that he was supposed to help with a J1 waiver search.

Save your money and find a reputable J1 waiver search consultant. In my search, I've learned that most reputable consultants only charge the employers a fee, and don't charge any fee at all to job-seekers. Also check with ARC, the Rural Assistance Center, and the VA.

Dear Consumer: First, I have successfully filed over 150 J1 waivers and H1B visas. I did "ten times" the amount of work for her (Aga Petersen), than for most of my other doctor clients. Anyone considering using my services is welcome to call my previous clients. I do provide a complete reference list-as I did with Aga Petersen. I also do not charge any placement fees. (this will be reiterated throughout my rebuttal). Nearly every time I made a particular job/location suggestion to the complainant-she turned it down. Mostly because her husband did not feel he would find suitable employment in the suggested location. (I believe he is an attorney and was completing an MBA at the time of Dr. Petersen's J1 job search) Coincidently, he also scrutinized and helped rewrite most of the consulting services agreement and thus, may be a source/catalyst of Aga's bitterness towards me. I am not quite sure. From the first time I had mentioned various J1 qualified jobs to Dr. Petersen until she decided to initially become my client, a period of 7 months had passed. Of course, once she decided to become a client, she was then extremely inpatient. This never made sense to me as-she just should have started her job search 6 months prior if she was so anxious. The initial retainer charged was to offset immigration paperwork and the research involved in "pre-qualifying" each opportunity for its ability to provide J1 waiver sponsorship. The cost of doing this for Dr. Petersen was far in excess of the initial retainer. Nevertheless, I do not charge this fee anymore. If the hospital is unwilling to pay for the legal costs of a waiver then- the doctor just won't have an opportunity to interview there. Many hospitals will not consider J1 or H1B doctors and still more will not pay fees unless the doctor is American born and trained (MD-not just residency) As Dr. Petersen is a Pulmonary specialist, this again limits the available jobs as J1 waivers are geared towards primary care doctors. Dr. Aga Petersen had told me she would probably be offered a job at her place of medical residency. I assume that, when this fell through, her anger was generated at me. It is also around this time that, Dr. Petersen asked Jeff Pearson to cease her job search. In the J1 waiver process, employers may take anywhere from 2 days to 8 months in there hiring protocol of physicians. I cannot control this and Dr. Petersen was unwilling to wait. She accuses me of causing her to lose a year's pay. In response, I commented that there were many less desirable locations and, if a J1 doctor is geographically flexible then, it is next to impossible not to be able to secure a job. This is quite true as places like Nebraska, Wyoming, North Dakota, Idaho, Montana and other western/mid-western States are "starving" for a good Pulmonologist. It is unfortunate that I can write whatever I like-even if I said "you are a terrible doctor with a miserable bedside manner" and this will be published. Regardless of whether it is true or not. It may just be an opinion. In addition, I do not charge placement fees or retainers, so it is impossible for a client to lose money. Once you have been in private practice a few years and the "frivolous" lawsuits start haunting you- you will better understand my position. Not to worry-they are unavoidable-no matter how perfect you try to be. Sincerely, Jeff Pearson
