Don't worry about breaking the contract with JK harris, they already have for non performance. As for revocovering your money, there are a couble ogf ways, neither involve a lawyer. First, depending on the amount, take them to small claims court. If the amount is less than the maximum allowed in your state. If it is less ask for the maximum amouent, (Massachusetts is $2,500.00), your state may differ. If the amount exceeds the small claims maximum, you need to file a complaint in district court. Now it gets more complicate, you can act PRO se, (represent yourself), and not get a lawyer involved, or hire a lawyer on a contingency fee basis. You can go the do it yourself route, you need to write the complaint following the Courts Rules of Civil Procedure, file it with the court so that it is placed on the docket, have a copy of the complaint served to JK Harris in South Carolina,(this can be accomplished by Certified Mail, Return Receipt), and have the co defendant,(the sales person), by the sheriff.

If you just go the small claims route, name JK Harri as the defendant, and the sales person as the co defendant. Use the office where you met as the service address. Ask for the maximum allowed by your state, whether they owe it to you or not. When you go to the hearing, JK Harris will not appear. Should they appear, they would have to explaint to the court why they haven't performed as to contract, and taken your money for two years. When the court awards you the judgmentbased on a default, ask for "Treble" damages, that's three times the amount, for the lies and hell they have put you through. If they don't show up, they cannot introduce a defense. Send a copy of the judgment to JK Harris corporate office attention Monica Linder. JK Harris still won't pay you. Thirty days after sending the letter to JK Harris, go back to the clerk's ofice, and ask for a "Capias", naming the sale person.  That is an arrest warrant, to drag their a*s into court and explain why you haven't been paid as ordered by the court. Send or fax a copy to JK Corporate, attention Monica, and send a copy to the sales person at the local office and ask them where they want it served, home or office. You should get your money at this point, for JK Harris is very protective of their cash cows.

HEY, I WAS TAKEN FOR OVER $5,000. AND OF COURSE, THEY HAVE AN EXCUSE FOR NOT GIVING ME A TOTAL REFUND.  ALL THE BAD RESPONSE BY THE COMPANY AND MORE LIES FROM THE COMPANY.  I AM WONDERING WHY I CAN'T HAVE AN ANSWER FROM ATTORNIES, TO SUE THEM.  I AM THINKING THAT I ALSO NEED TO SUE FOR THE LEGAL MATTERS THAT THEY HAVE NO BUSINESS GIVING.  I HAVE LOST AROUND $100,000. - LOSS OF EQUITY FROM MY HOME, AS I WAS TOLD BY SEVERAL EMPLOYEES, NOT TO SELL MY HOME AND WE KNOW WHAT HAS HAPPENED TO THE REAL ESTATE MARKET.  NOW, I HAVE LESS MONEY TO GIVE THE IRS AND HOW AM I EVER GOING TO GET IT??

I DID FIRE THEM BY SENDING THEM A LETTER.  I FINALLY DID MY OWN OIC AND SENT THEM OFF TO THE STATE AND IRS.  I CAN'T BELIEVE THEY ARE SAYING IT TAKES A LONG TIME FOR THEM TO EVEN FILE.  JUST GET ON THE INTERNET AND LOOK UP IRS/STATE-OIC FORMS.  THEN YOU ARE GOING TO NEED ALL YOUR FINANCIAL STUFF, INCLUDING BILLS, CHECKING ACCT., HOME, ETC.   IT WILL TELL YOU EXACTLY WHAT YOU WILL NEED.  IT IS CONFUSING AT FIRST, BUT ONCE YOU READ IT SLOWLY AND GO SLOW THRU EACH PAGE, YOU'LL GET IT.  ONCE I STARTED TO WORK WITH THE IRS/STATE, THE POWER OF ATTORNEY WAS NULL.  CALL THE IRS AND STATE AND EXPLAIN THE SITUATION TO SEE WHAT THEY SAY ABOUT THEM AND WHAT YOU CAN DO AT THIS POINT.  IT WON'T GO AWAY AND IF THE IRS KNOWS YOU ARE TRYING, IT MAY PUT OFF SOME OF THE ACTIONS.

JKHARRIS DID ADMIT THAT WE WERE OWED A PARTIAL REFUND.  FIRST, THEY WANTED US TO SIGN A PAPER THAT TOOK AWAY ALL OUR RIGHTS.  WE DIDN'T SIGN IT AND TO ADD TO THE INSULT, THEY WERE ONLY GOING TO GIVE US $60.

I AM WONDERING WHAT KIND OF SUIT I COULD HAVE FOR THEM TAKING OUT MONEY, INTERSTATE, FROM MY CHECKING ACCOUNT, KNOWING THAT THEY ARE COMMITTING FRAUD WHEN THEY SAY THEY WILL HELP US WITH OUR TAX RESOLUTION?

OF COURSE, I HAD TO DO ALL THE WORK AND THEN A HIGHLY OBNOXIOUS GIRL GOT ON THE PHONE AND ACTUALLY REEMED ME OUT!!  IT WAS CRAZY.  THAT WAS MY ONE OF MY FIRST CLUES, THAT SOMETHING WAS WRONG.  THEN I LOOKED THEM UP ON THE INTERNET, BBB AND WOW!!  I SAW THEIR COMMERCIALS ON TV AND I THOUGHT THAT THE TV WOULDN'T LET THIS HAPPEN.  DON'T THEY MAKE SURE THEY ARE A GOOD COMPANY, BEFORE THEY LET THEM ON TV.  AT LEAST A DISCLAIMER!!!  I NOTICED THEY HAVE CHANGED THE COMMERCIAL.  EVERY TIME I SEE THAT GUY ON TV, I CAN'T BELIEVE IT CAN GO ON!!  NOW, THEY ARE ACTORS.

I DON'T KNOW HOW ANY OF THE EMPLOYEES CAN GO TO SLEEP AT NIGHT.  I JUST BELIEVE THEY ARE OF THE GROUP THAT ARE DISHONEST AND SCAMMERS.  THEY HAVE NO CARE OF ANYONE ELSE, BUT THEMSELVES.  TOO BAD THEY DON'T REALIZE IT IS THEMSELVES THEY ARE HURTING AND SOMEDAY THEY WILL HAVE TO MEET THE LORD.  WE ALL WILL HAVE TO TAKE ACCOUNT OF OUR ACTIONS.

WE ALMOST LOST OUR HOME AND I CONTACTED JKHARRIS THAT I NEEDED THE MONEY TO KEEP OUR HOUSE OUT OF FORECLOSURE AND THEY NEVER EVEN ACQKNOWLEGED IT.  DIDN'T CARE.  WHATEVER.  THANK GOD I GOT A MODIFICATION AFTER 6 MONTHS OF WORRY.

ANYWAY, PLEASE LAWYERS, FIND ME.  I DON'T HAVE MONEY, BUT COULD YOU JUST GET SOME OF THE MONEY, SHOULD I GET RESTITUTION?
