I was out sick from work yesterday, but working from home. I got an email from my boss that some guy said he needed to server herself and I court summons. She asked him what it was about and he said he couldn't say, but gave her a number she could call. She asked if she could have her summons and he said he'd rather come back tomorrow - all of this on the phone. So, I called the number he gave her, 716-381-9879 (Buffalo, NY). and Randy Newberg answered. He said I owed a debt. I asked who the company was and he was confused and said his company purchased the debt. I asked from who? He gave me Cash Yes and Cash Jar and said I borrowed $350 from them on May 7, 2010. I said, well, I've never heard of those companies before and if this is legit, then I have proof of payment for any payday loans I took out. He said, then just show them in court. I said, I don't want to go to court and I don't understand why my boss would have to go to court. He said, she just needs to tell them she had nothing to do with it. I said, ok, I'll wait until tomorrow when I get served.
This morning I checked my voicemail and got a call from John Swanson at 214-218-7421 (Grand Prairie, TX) saying he was across the street and had a court summons for myself and my boss. I know the law and process servers just go and serve papers, they don't call first. If they do, it's to verify the address. I checked with my boss and our office manager and no one came up, just called. Also, check out the website www.franklinandruggiero.com There's no phone number or address, just a contact me form. For a "legit" law firm, this is a terrible website.
I don't know who these two guys are and what type of scam they are trying to pull, but I filed with the FTC, my Attorney General, put an alert on my credit report and complained to the Better Business Bureau. So, if they do try to "come back", which they haven't, I can call their bluff.

First of all we do file claims for bad checks which are debts that are owed. You know that you owe the money, So it won't do any good to come online and post complaints simply because you don't want to pay back what is owed. If there is any issue regarding a payment letter we can be reached at our office number at all times. If you would like a refund and have legal action taken instead, there is no problem with us doing that. Keep in mind that going to your bank and signing an affidavit of fraud saying a charge is unauthorized when the call was recorded and actually was authorized is a criminal offense of itself. That is why the bank makes you sign the affidavit before doing a charge back. An affidavit is a legal document and any false statements made on it are criminal. Look it up.

Call the credit card company and tell them it was a unauthorized charge...I doubt either of them had it recorded...That happened to me with another company and I let the bank know and they cancelled the payment and the "company" never tried to take money again.

I received the exact same call and text and it was handled in the same manner. The only difference is that I was dumb enough to give them a credit card number which they drafted for $255 they scheduled another payment to run this Friday and when I called back to reschedule the payment I received no answer. I was naive enough to believe them not completley knowing what exactly they were referring to and nor did I receive any type of email correspondence or a receipt for my payment.
I'm sick over this.
