KACW Investments - Lease Option in Florida Home Rent to Own Scam.

Back On January 7th 2 days after I listed my home on Buyowner.com I got an email from a Joanne Pearce at KACW Invtestments in Orlando. She offered to purchase my home on a lease option agreement. She sent me the agreement after several requests to do so.

After reading the agreement and deciding to take her Option 3 which was to Lease my home at 1050.00 per month for 2 years and then buy the home at my asking price of 179,000 I made changes to the contract. The changes I made cleaned it up and made it much more clear - especially in terms of the payments and due dates and interest. I sent the contract back to Ms. Pearce and a few days later she returned the contract basically deleting all of the changes.

On March 8, 2006 I signed the agreement as is and returned it to her. In the agreement it says that she is to inspect the home and send payment for the 1st month plus the 2000.00 security deposit within 21 days of signing.

Having not heard from her regarding the contract nor the inspection, I called Ms. Pearce several times. On a few of the occasions a female answered the phone and said she would take a message for Joanne Pearce. One of the times I called that same female answered and when I said "Joanne"? she said yes this is she...I discussed with her that I would allow a few extra days from the 29th of March for her to make payment...thats when she sarted to hum and haw about even making the payment...I got the feeling I probobly would never see payment from her..

It's been 2 weeks since that conversation. When I email her from my aol to her email - [email protected] I see she is just deleting my emails and when I call she never answers and it goes to voice mail which she never ever returns...

BEWARE ALL SELLERS BUYERS- she is not a licensed real estate agent neither are Michael Pearce or Helen J Pearce who are officers of this newly form corporation. These are red hot signs of a rent to own rip off company...

Perhaps the rebuttal of Ms. Pearce should be looked at and responded to with the facts: First off, we are the consumer. You cannot rip off the seller. Money never transfered hands. John Moceyunas never gave us that chance. We had a verbal agreement to lease option a property from John Moceyunas. Response: No, there was a written contract which was signed on March 8, 2006. He refused access and ignored our requests for access to the property and when we decided not to do a deal with him, he starts calling and sending e-mails and we show him the same treatment he gave us by ignoring him, he cries about it. Response: On March 8th both the contract and the keys to the property were FedExd to KACW at their UPS Store mailbox. The Package was signed for on March 9, 2006 at 1:10 PM by an F Aragon with Fedex Tracking number 791881323855. How is this refusing access? I highly suggest that no one buys this property from this man. He's a con man, and when he doesn't get his way, he cries about it. He's highly immature. And when he posted his blog, you should see the reply he sent, and you will see the immaturity I'm talking about. Response: Con Man? That implies that John was trying to CON someone out of something. Here's the Facts: KACW Emailed John. KACW Sent the contract which John Signed and sent back. KACW agreed to send (in a phone call between John and Joanne aka Helen on 3/24/06) the deposit plus the signed contract and they didn't. SO How is John a Con Man? Call him a disillusioned homeowner that almost did business with a rather questionable 27 year old "businessperson" (Wink, Wink), and thats believable. As for the emails about immaturity etc. perhaps you can read the one below that was sent to John on 4/17/06: at 10:23 PM from KACW to John Moceyunas: We don't really care. We've giving that other party 24 hours to remove their posting just like you. You will do it or face being sued and criminal prosecution for fraud, and yes we have proof, and we have our contract to back it up. And no, you never had a lockbox put on, you refused to put one on. And just for the fun of it, we will post a blog about you too, and make sure that it is completely false too. We also asked you not to harrass and you have, you can consider yourself reported to the Sheriff's Department. Your e-mail has been blocked, and I would love for you to try to respond again. I will have you arrested faster than you can say "I didn't mean it." Thank You, Helen Joanne Pearce (I go by Joanne, no confusion.) KACW Investments P.S We will see you in court. Response: The lock Box is still on the front door - the house is still for sale. I especially like the part where she admits that she is posting something that is completely false. I also love the threats of having John arrested faster than I can say "i didn't mean it" This response is coming from the person that claims John is "Highly Immature" Joanne AKA Helen Aka Ms. Mature, No one here or anywhere is threatened by you, your company or your ridiculous scare tactics. You might also want to note that your advice "highly suggesting that no one buy the property" and your subsequent admission that your posting would be "completely false" and your description of John Moceyunas as a "Con Man" IS much closer to the definition of slander than anything anyone on RIPOFF report has reported about KACW. Perhaps you should pay a few hundred and retain an attorney and review with him your postings and emails and find out where you stand in terms of the words Fraud and Slander. Or maybe better yet take that retainer fee and pay the guy who you did make a deal with on timely basis and return phone calls and conduct yourself in a bussiness-like way and you won't ever have to deal with complaints on here, the BBB or the Attorney General. Another suggestion: Stop throwing around all these terms around like ( Like Fraud Slander, sue, Sheriffs etc) you have no idea what you are talking about, the more you write the more you look ridculous.
