I am in dispute with a company called Keepsake Expressions, Inc., located at 2632 Mountain Industrial Blvd, Suite C, Tucker, GA 30084. I responded to an e-mail advertisement (this is not my first time dealing with this company) about a Summer Layaway Offer Extended Plan.

This was initially started in May and to date they still have not sent my products or refund my money. I called the company in Aug/Sept. to inquire about taking

out the last draft payment. I was then told of the managerial changes that had taken place and that my order would be fulfilled. This was after leaving messages at number that is now disconnected.

I just happen to call and reached a live person instead of a recording. On October 14, 2003 I received an e-mail from Kimberly Smith (VP Customer Development) apologizing about the delay. The e-mail address associated to this company is expired since that are over their quota. The original telephone number and toll-free numbers have been disconnected ((770) 491-8333 and (877) 453-3773). This is not acceptable and bad business relations.

I made another call to the company on December 7, 2003 at 10:30 pm (a recording informed of the new number and its associated to a Bailey Lenell, located at 2927 Athena Ln., Lithonia GA 30038) and after threatening to make a formal complaint, I then reached Kimberly. She told me that they do not ship direct that they deal with another distributor and she was going to find out the delay and call me on Monday, December 8, 2003. Ms. Smith once again has sent out some misguided information. I left several messages until they decided to turn off the answering machine. The one piece that I was interested in purchasing was a Summer Special worldwide and now the piece is not available.

I have filed a complaint with the Better Business Bureau. I have noticed that they have received two (2) complaints and have settled one and chose to ignore the other one. There is no effort on their part to help me, so Ms. Latricia Smith, known as the President and Ms. Kimberly Smith, Manager / Customer Service is fraudulent.

I do not have money to waste and give away. Any way that you could assist me would be greatly appreciated. I have attached copies of e-mails and the invoice that prove what I am saying is legitimate. To make matters worse, she's an attorney who returned back to work.

Like I stated, this should not have taken two (2) additional weeks. Considering the facts, if the check clears within three (3) days with no problems, I will settle the matter and let everyone know that Ms. Smith has made good on this debt only if there is no problem with the check. We have until Wednesday afternoon (12:00 noon) to settle. If my account is charged any fees for insufficient funds on Keepsake Expressions or Ms. Smith part, I will file the suit, its just a matter of changing the dates. The team I am working with is not very happy that I am waiting, but this is to really see if she is a woman of her word. I did not want this to turn nasty, but let's be reasonable. The only time I was taken serious was coming to this site. Truly, if the tables were turned, what would you do?

The owner/president Latricia Smith contacted me 12/15/03 around 7:00 pm Eastern Time. She promised to pay off this debt and that it was an error and she would mail out the check tomorrow. Since then, I had to make several calls to Ms. Smith regarding payment. Now she claims that she actually mailed it Tuesday, December 23, 2003. Still there is no check. It has now been about two weeks and Ms. Smith is still telling lies. She claimed that she mailed it from her job and they only have one mail service per day. Now, what kind of law firm does she work out of and she claims that she never mails anything from her job, but she decided to mail this mystery check. She also informed me that she has an attonery now. due to the Holiday season it should reach me by 12/31/03. I asked her was she prepared to clear this up today via Western Union and that I there is someone down in Georgia today to file papers against her personally and her company. She is suppose to call me back, but no word. She is a very big liar and now she wonders why her business partners screw her. The contact number for Ms. Smith is 770-722-2554
