This guy purchases office equipment from ebay sellers. He gets them to send the item then cancels the check and says he's keeping the equipment because the machine is not up to his standards.

He's is well aware of the Model and description of items he purchases, he even got a picture so he could see it. He's done this twice so far with different sellers.

He canceled his check, kept my machine, and I had to pay for listing the item on ebay.

He did the exact same thing to another seller with a computer.

Don't trust this guy! Don't let him buy from you! Don't be the next victim he rips off!

If a person is going to judge an issue, it is prudent to fully hear both sides of the story and validate the circumstances.  Things are not always as simple as they appear.  Nor is the best communicator always right. If you don't do your homework then it is best to leave the Judgment of matters to those who do.

Seller sold me an outdated, no parts available, non-working copier.  I payed the $20 bucks and stopped payment on my check and offered to return if the seller would pay for the shipping.  They declined... so waited about 6+ months and trashed the stuff.  If they got e-bay to pay then the seller ripped off e-bay????

Purchased a copier on e-bay and sent a check to the seller.   Received the copier but it did not work.  Took it to a repair service, could not be repaired, outdated.  So stopped payment on the check and requested funds to return the copier to the seller.  The seller did not respond except for a negative report to e-bay.  After 6 months I trashed the copier and thermal paper and forgot the matter.  Seems the bad report is still around.  Never ripped off anyone, ever....

This person sold me an old ThermoFax Machine that was supposed to be in new condition.  The price was right and it came with paper so I purchased it and sent a check.  When the machine arrived I tried it out, it did not work.  Took it to a Tech, he said that it could not be fixed.  I stopped payment on the check and contacted the owner for the funds to ship it to Canada from Hawaii.  $52.00 US.  She did not send the funds within the 30 days I allowed so I took it to the dump.  Could be it was damaged in shipping it was not packed very well.  But it could be that it was not working when sent.  I was glad I could stop payment on the check.  Would have been happy to send the junk home.  Not sure about the slander of two other ebay sellers as I normally pay by Credit Card. I can not think of having any other difficulties.  Of course with a name like Ken Smith, there are a lot of us floating around.  Just got nailed for a gambling fraud and don't gamble.  Even listed my web domain to prove it was me.  Seems too me that I nearly got victimized on this busted ThermoFax Machine.

I know your frustration, and and so forth, but please focus a minute ok? please let me explain to you about something. ebay is a place to BUY or SELL products,if you DEPEND upon a place(like ive been seeing MORE and MORE pop up as "sell your stuff on ebay here")shop plaza window 'sell it on ebay bullshit' type of deal,YOU ARE actually SCREWING YOURSELF EVEN MORE out of money because the ONLY d**n THING THEY WILL PROBABLY DO IS list your item under THEIR (whatever you wanna call it) and tell you(if it actually sold)that you made $40.00 on your item(exaggeration of situation because of situation unknown)when the greedy %$#@!*&!!!! ACTUALLY MADE nearly TWICE the amount they told YOU,then DEDUCT,SHIPPING,THEIR FEES,AND WHATEVER THE HELL THEY CAN THINK OF,on the tab also, and then you get what ever is left, not very d**n good is it?so WHY settle for this when you can put it on ebay YOURSELF????????,you d be MUCH BETTER OFF.

Was able to get paid - only by the skin of my teeth

Final update I did get paid and so did the other ebay seller... not without lots of trouble on both our parts. My recommendation would be to stay away from this guy... it's nothing but trouble for the Ebay seller in my opinion. I sold him a fax and the other ebayer seller sold him a computer. I sent the fax before I got paid even (stupid), the buyer says to both of us, seperately, that he is keeping our equipment and canceling checks made out to us! He didn't think my model was up to his standards, he had a newer fax model of his own. (Oh well!!) Of course my fax worked, who would mail off merchandise without getting paid first, if they weren't confident it worked?!?! I was able to cash his check in the end, luckily my bank got it to pass, as for the other seller after sending legal letters and contancting his lawyer, he got paid too. Many thanks to TFC and the rip off report.

Shannon, There is no need for you to suffer just because the fraudster lives on the Islands. Contact Police Sergeant Sam Kawamoto, at (808) 326-4222 for the Kailua-Kona area. He will be a good place to start--tell him your story. You may press charges if you like for theft. The charges will be based on mail fraud, wire fraud, theft by deception and a myriad of others. Snap to it and seek justice. Good luck! TFC
