I just got scammed by an eBayer that goes by the name of babypookielove. Her real name is Kerian Lovell and she resides in Barbodos, but her eBay account shows Maryland. However, she had me send to an address in Miami, Florida that  belongs to a Janice Sterling. This all should have been a red flag.

This eBayer recently made a claim with eBay that a brand new dress of mine reeked of smoke, which isn't true at all since I don't smoke and don't have a smoker in the household.  She dramatically claimed (on November 24th) that my dress triggered her asthma and that she had to be nebulized 6 times. She even said this caused her to GAIN WEIGHT. I immediately sent this dress after she made payment.

She started making these claims on November 24th, way after she ordered the dress and received it. This gave her enough time to wear the dress and demand half of her money back by making false accusations. On December 11th, she issued a partial refund to have it professionally dry cleaned, yet she wants to KEEP the dress. I was selling this dress at a good price, and she basically wants an expensive dress next to nothing. I believe this buyer wore this dress for it to smell like sweat and smoke  (or she's simply lying all the way around), because I know I've never worn this dress since it was too long for my petite height. Plus, I'm no longer the size 12 when I bought the dress (size 10). Otherwise, she wouldn't ask for a partial refund. She would simply send the dress back.
 I thought something was fishy when she wanted it sent to an US address instead of the non-US address that she is located.

Needless to say, her story doesn't add up at all. Either she or her friend smokes. Or, one of them has been around a smoker. Then, they want to make an outlandish claim at the last minute after they've had plenty of time to wear the dress. After doing further research, I've realized that the partial refund scam is quite popular on eBay.

I am responding to this case because it is not only unfair but wrong. It shows a person who lacks conscience. Buyers Beware -If you see this person on ebay (moroccanbreeze) please do not purchase, or you may go through a nasty experience with this person.

There are truly some wicked people on this earth and this only proves it. The length that this woman would go is beyond believable. I am going to include the messages between us for people to have a "fair" judgement of what went on. There is never one side to a story. In truth if she had apologized and seemed sincere I would have let it pass, but the woman told me she can only think that someone who tried it and returned it must have smoked, which is why it has the scent. Does that even make sense that she would not pick up the scent?

Funny thing is, and why I am upset at myself is that I still gave her positive feedback because I really do not like leaving negative, and since I have the dress, I gave her positive and wrote the facts that the dress reeked of smoke.

I was in the US staying with a friend, and am in Barbados now, and I emailed this to ebay customer support after I escalated the case and asked them to close it.

She has only been on ebay over a year, and her last sale before mine was the 18th April, 2011.

This woman told me how "nice" and "kind" she is, and loves helping people. Yet she has never owned up to what she did. People make mistakes, but she never wanted to admit it, and chose to call me "mentally ill" instead. She told me how she knows for a fact that her sister is a smoker and asthmatic and has never been affected by it, so she is calling my bluff! She never asked how I felt, never apologized!

Why would she go on to argue about me saying the smoke made me ill, unless she was aware the dress smelled of smoke?

I have 360 Positive Feedback on my profile, and I have been a member of ebay for 5 years. Around that same time I also purchased another dress which cost double the amount of her dress, and the seller gave me rave reviews. I asked for a partial refund because of having to dry clean the dress...I did not ask for a full refund. Who would make up something like that for a few dollars?

I think it is sick and twisted to scam people out of their hard earned money, and if I had wanted to go down that route which is despicable I would have "simply" made a paypal claim that I never received the item. I did receive the item however, but it was certainly not as described, and after she lied, I opened the case.

To go and put personal information up on the internet like this and claim that I am a "partial refund scammer" sounds silly and I truly truly believe in "do onto others as you would have them do onto you". This only proves the kind of woman she truly is.

I am contacting you because of a few problems with this dress. I was not going to say anything, but Your auction says that your home is smoke free. I would like to ask if this dress is new, because it appears to be used, fine I can accept that but the main problem is that smells so strongly of smoke, that it affected my asthma immediately and made me very ill. and the scent cannot be cleaned. Anxiously awaiting your reply.

I'm sorry that you feel that the item wasn't described accurately. However, I can honestly say that this dress was tried on only once since it was too long for me. Plus, I'm no longer that size (size 10). I have never let anyone wear it either since I don't let people borrow my clothes. It has stayed in my closet for months. Also, I have never smoked a day in my life, especially since cigarette smoke aggravates my allergies. No one else smokes in my household either, and I don't allow visitors to
smoke in my house. I bought it at Boutique Larrieux in Wisconsin. The only thing that I can think of is that someone else had bought and returned it for it to smell like smoke.

I'm not sure how you figure that, because it's your message that doesn't make any sense at all. I shipped the dress as soon as you made payment. You contacted me on November 24th, claiming that the dress reeked of smoke. If this were true, why would it take that long to contact me? December 11th, you asked for a partial refund without wanting to simply send the dress back. Now, if you can't wear the dress or have it cleaned like you said, why are you wanting to keep my dress? This tells me that
you that this gave you a chance to wear the dress, and now you want your money back after wearing the dress for whatever occasion that you bought for. Makes me wonder if you're in need of Christmas money. I believe your story is completely fabricated, because I have a sister that lives a a couple states away - she happens to have asthma and she
smokes! I stick by my word since I know for sure that I don't smoke, and the dress definitely did not smell like smoke. I kind of had a bad feeling about you when you first contacted me about this issue, but more and more it shows that you're trying to completely rip me off. If the dress cost so much, why did you drop the price so low? I am done with this. You are being dishonest. I do not even care what the result of this case is anymore. It sickens me when people are so dishonest when all you had to do was be upfront. You sound very uneducated on asthma to be boasting about your sister smoking when she has that conditions.
That....is one for the books. I thought you suffered allergies as well...obviously another fabrication. None of what you have stated makes sense. I took awhile responding, yes. You can keep the money because YOU obviously need it. BUT..I ask that you think about what you have done and not try to pull a scam on someone else. I gave you the benefit of the doubt, I gave ebay the benefit of the doubt thinking I got an honest transaction when it was not. It's the whole principle behind this
matter that I pressed this issue. You are wrong, and yet strong with it, and that is the scary part. I said to myself...is it possible this happened in shipping? But that is impossible. Anyhow, I will not think on you or this matter anymore for it is not worth bothering over this wonderful season. The dress was meant to be sold to amanda_softballmom since she discovered the first listing at the last minute and was wondering if I could sell it for less since she's a struggling single mother. I love helping other people. That's the kind of person I am. That's why I re-listed it for a second time. I wasn't expecting someone (YOU) else to bid on it but her. She was a little disappointed when you won, but understood since I had to follow the eBay guidelines. I'm not a dishonest person at all.
People like you just appall me. And, I wouldn't brag about anyone having asthma and smoking. I don't approve of anyone smoking, but I can't tell my sister what to do. She's a grown woman and doesn't live with me. I'm just calling your bluff and using her as an example, because I know people with severe asthma. And yes, I do have severe allergies and will
say it again, THE DRESS DOES NOT SMOKE, BECAUSE THIS A NON-SMOKING HOUSEHOLD. If it smells like smoke, it's because you're a smoker or have been around one while wearing my dress. Well it just shows the different type of people we are. I wont insult you, or call you names. Please go and read. You can argue and say all you want about the dress. Fact is fact, it reeks of smoke and it boggles my mind that people are so uneducated that you actually took the time to argue about something that has killed many asthmatics. I told you how sick I got from this dress and your first instinct was the think "protect myself", you did not think to yourself...is it possible the dress reeks of smoke? How could I miss it? No you instead argue that I am calling a bluff that inhaling cigarette smoke does not affect asthmatics. Thank you for the laugh, this is the funniest thing I have heard in awhile. I don't think you are a bad person, but you made a mistake and won't own up to it. Funny thing is, if you had even seemed concerned, asked how I was etc, then I would say you are a caring
person, you made a mistake and let it go..but the excuses seemed false. I had to be nebulized 6 TIMES! and I have been on Prednisolone for 3 weeks, and have gained weight because of how ill this made me. I won't let you spoil this season for me.It's a dress..a material thing. Not worth it. Do not contact me again.

I know for a fact that I don't smoke. Therefore, I don't have time for this non-sense. You keep beating a dead horse. You've still failed at answering my question. Why didn't you request to have the dress sent back to me rather than keep the dress and get partially refunded? That doesn't make sense at all, especially when you're making extravagant claims that it reeks of smoke and aggravates your asthma. A normal person would send the dress back and request for a refund, NOT KEEP THE DRESS and get partially refunded (might as well call that a discount). Even a blind person would see through this and see that you're trying to
con me out of an expensive dress. If you couldn't afford it, perhaps you need to stop eBaying.

I think it is a shame that this woman can try to put a smudge on my character and put personal information online like this. My regret for the year 2011 was purchasing this dress. I did not deserve this to happen but in the end it was a learning experience.
