Never got a photo of the first pick until the 6th week puppies were unmarked with color , black red , blue etc. He called me and said that I had first pick ( black). Three days later he called and said green is the first pick . This was very shady. I defaulted on buying him because I didn't trust him any more. His reason for the mix up is that he's color blind.. Smh stay away if I was you!

First notice that No One Was Ripped Off Here, he backed out of the purchase.

Deposits are NON-Refundable, this is industry standard.

I find this very odd he would do something like this because when he got his other "female" puppy it was sick since he received it. He said the other breeder was not helping him and what should he do. He told me what course of action he has already took and I told him what I would do. I must have spent an hour on the phone with him. He called back two days later telling me how everything I suggested worked and his puppy is making a speedy recovery.

Lets give some background, Mr. Henderson said he wanted a MALE puppy because he bought a FEMALE from other breeder. He also stated he wanted full breeding rights since he wanted to start a breeding program.

I learn two nights ago he has purchased two other MALES from two other breeders, including the FEMALE above is really a male.

It is true I am color blind and it is true I mixed up Hunter Green with Black when I bought collars but I bought the collars AFTER I talked to Mr Henderson on the phone. I was on the way to the Country Store to buy them when I was explaining the difference between the two puppies to Mr Henderson.

As you are reading you will notice that Mr Henderson thinks the most aggressive dog should be first pick and be used in a breeding program. I am sorry but I strongly disagree. Also you will notice that the only thing that got mixed up was the color of a collar.

Finaly notice that in EVERY email I gave Mr Henderson a choice some times three choices.

The puppies are now 6 weeks and 4 days old. Pictures of the puppies have been posted on Facebook since day 1, 1 week, 3 weeks, 4 weeks, and now 6 weeks.

 

This is nothing more than a simple misunderstanding that went haywire very fast, it was almost as if he was looking for a way to back out of the purchase.

 

Here is every email since the mistake.

Hey Carl,

I misspoke on the phone the other day 1st pick is green boy, red boy is bigger (6 ounces) but has white on his chest so he should not be used for breeding. Green also has a better bite and stable temperament over red. Red is more aggressive and is the second pick. Since my second pick client wants to use him as a fully trained protection / Schutzhund dog when he gets older I have to recommend he gets Red Boy and you take green boy.

Carl,

I am not going back on my word, let me clear things up for you.

I am color blind so while I said black boy and red boy it should have been green boy and red boy. There is no black collared puppy (male or female) in this litter.

Green Boy is my number one pick he has no faults at all, he does weigh 6 ounces less than red boy but at this stage in the game 6 ounces is nothing. If it was 2+ pounds then I would be worried. This weight difference could be as simple as Green Boy ate less or produced his waste faster to poop out the weight. Green Boy also has wider ghouls (mouth) and girth (chest), which tells me in the long run he will be the bigger of the two. You have to remember size (especially at this age) is not everything. Green boy has a better temperament over red boy, Green gets along with all his litter mates and does not bully anyone. This means he will be less likely to challenge you, your family, or other puppies for his position in the household.

Red boy is my second pick because he has a white patch of hair on his chest and that is considered a fault. While I know it will go away because he was not born with it his offspring could be born with a white patch. Red boy is going to need a lot of training and channeling of his aggression that could cost quite a lot. Since the second pick client is training their puppy for protection this will not catch them by surprise.

I would rather give you the best possible puppy for you than give you a puppy that could be bred later on in life and produce faults in his offspring.  

If you want red boy you can have him as you are first pick and that is your right. However if it was me and my experience I would choose green boy.

Either way the choice is up to you I want you to be happy with your choice.

As far as my word, I promised you would get first pick male, your deposit is non-refundable unless I stop my breeding program and cannot produce a puppy for you. Neither of these are the case here.

Finally none of this is set in stone until the day these puppies ship. Picks are subject to change based on the client’s needs, wants, lifestyle and the puppies development over the 8 weeks they are in my care.

(Honest is how he makes his living but Lori from Stoney Creek didn't even know who I was until after this email was received and I called her and left a message. She called me back and we talked for hours. Great person sorry this client felt he had to drag her name into it. Sorry he had to make up lies here)

Carl,

Then be a man and finish what you committed to. I have been totally honest with you from the beginning.

 This is a very simple case of a misunderstanding. When I talked to you on the phone I was describing Green boy. I had not put any collars on the puppies at that time. The collars did not go on the puppies until we gave them their first shots one Friday.

 Since I am color blind I thought the dark green collar was black and while I was on the phone with you I did not want to say you are getting "black boy" as I did not want to offend you. As the shots were given is when the collars were put on. That is when I saw that the Red collar was put on the second pick and the Green collar was put on the first pick. Since the collar was not black I didn't think anyone would get offended and sent you the email explaining the different and I said " I have to recommend". The choice was entirely up to YOU on which puppy you want to receive.

 If you remember right when we were on the phone I said black boy has a white patch on his chest and should not be used for breeding.

 So now I leave it up to you, if you want to fulfill your commitment I am more than willing to work with you. If not I understand and good luck.

Either way sorry it has turned out this way, this is why I hate emails and why I try to explain everything over the phone.

I have already put my ads back up and received a puppy application on him so Please just let me know within 24 hours what you would like to do.

I waited a day and sent him a final email

Carl,

 

Over the night I have another buyer that is interested in the puppy. So I have decided to handle this one of three ways since it was made clear puppy deposits are non-refundable from the beginning.

 

  1. You can chose to get the original puppy you reserved from this litter. Which is First Pick Male no matter what color the collar is, it is your choice.

Or

  1. You can for go your puppy selection at this time and move your deposit to another litter at a later date. If you chose this option I would have to subtract the advertising cost of $20.00 bringing your deposit balance to $280.00. Also at the time you reserve your next puppy I would need an additional deposit of $220.00 to reserve your selection from that litter as good faith you will not back out of that puppy. That would be a $500.00 total deposit

Or

  1. Forfeit your deposit completely. If I do not receive a response to this email by the close of business I will take it as you have forfeited your deposit.

 

Again sorry it has come to this and I am sure if we communicate more effectively we can resolve this issue. My ultimate goal  is to give you the benefit of the doubt, and place our puppy in a proper home. The choice is yours and I am willing to work this all out as you see fit within the choices above.

I don't deal with fake or phony people as yourself. I trusted you with my money . The deal was shady. In the court of public opinion the most aggressive and bigger dog is always first pick. What you did was sold that pup from under me. I'd rather lose that than to let you screw me out of more . Your story is full of holes. I don't trust you and will never think about doing business with you again!

This will be my last email.

Since you have not replied to confirm you have forfeited your reservation I can only assume you have based by your last email.  I will be accepting the new client that is waiting to put down his deposit.

I have included updated pictures of Green Collar boy. After just two days he is now the biggest of the litter (by 8 ounces) and you can tell his size by using his paw against my daughters hand. He is a very big boy, short muzzle and has an outstanding temperament. A temperament that any well breed ethical breeder would love to have in their kennel. It is my job that I match the perfect puppy with the perfect home, that is all I was trying to do, you should have trusted my experience. I told you that 6 ounces is nothing at this age and I meant it, even better this is proof!
