On Dec. 20th, 2008, I found what I thought was an internet promotion on the "La Fiesta Inn" web sight. They had a particular room advertized for $0. per night for 2 nights. The other rooms were different prices. I booked that room for those 2 particular nights. My credit card was charged some kind of tax and a confirmation was emailed to me.

I was very excited as I had just finished cancer treament and this would be my celebration trip. The special made it financially possible.

I called the hotel to see if I could change the reservation dates. I was informed that even though the clerk could see where I had reserved the room for my confirmed price, they could not honor my reservation for the orignal or any other dates but they would give a 10% discount off the regular rates.

On Dec. 21st, I received an email stating that the rate for my room would be $179.99 per night. Six days prior to arrival my card would be charged $182.54 for the first night. The rate shown was before the 10% discount to be applied at check-in. It was written like a confirmation.

On Jan. 3rd. I received an email asking me to let them know if I would be keeping this reservation or they would cancel it on Jan. 15th. I emailed them back and told them I did not want to report them to the BBB etc. and wished to work this out amiacably. I asked them to honor my orginal reservation.

On Jan. 14th I received an email stating "In as much as you have clearly stated your dissatisfaction with our Inn prior to arrival and since there is ample time to find alternate lodging, it is in our mutual best interest that we have cancelled your reservation."

The hotel is allowed to back out of the reservation for at least a couple of legal reasons: 1. The advertisement on the internet is not an offer - it is an advertisement. It does not offer a room at $0 for two nights for anyone to accept at that price. 2. If there is a material error in the advertisement that a reasonable person should have known and seen, the price could not be forced against the hotel by a consumer. In this case, the busiest time and most profitable time of year for hotels in Florida is December/January and as such - offering a free hotel room could be considered a material error, when the regular price of the hotel was $200 per night. When they asked if you would either keep the reservation or cancel it, you answered by stating you wanted them to honor the original reservation. Since that was non-responsive to their question (and from their response to you - you probably had some choice words for them), they cancelled the reservation. They had little choice based on your response. I don't think it's a rip-off.... since there is nothing free in this life...

We are a very nice 45 room boutique oceanfront Inn directly on St. Augustine Beach. We do not give away rooms free as an internet special. Our ocean front rooms are priced is the same for 1-4 people. We are very customer service oriented here and we all tried, including myself, to accommodate this person without success.
