I honestly don't even know where to start with them because my complaint is regarding billing issues, customer service and failure to honor refund. On 2/16/07 I noticed two charges in my master card statement, one for $37.09 and the second for $283.14. I immediately call the gym only to be told that i had to wait until monday for the manager (Carlos) to help me. I then call the corporate office who tell me they can't do anything for me that should be handled at the gym. So i call back monday and the manager tells me first to call corporate because he can't do anything form the gym. After I told him i had done that already and they said he had to fix that, then he tells me that by mistake they charged my credit card for someone else's membership. He also says that he will investigate further and call me back.

I week later he calls and tells me that they will refund me the money within 5-7 business days. So i wait and still no money, I call back the gym and they tell me that it can take 7-12 business days, again I wait. Still no money. So i call the corporate offices and they tell me that there is no note on my file regarding any refund but that he will put it in and that I should wait an additional 5-7 business days. Again i wait and no money so again i call the corporate offices. I waited on hold for 10 minutes then finally get a customer service rep who gets all my information and then hangs-up on me. Still i call again and am told that the refund shows in the other members file - the guy i got charged for, also, they don't know why the refund didn't go through. Again, they told me they would put it in my record and that I should wait more days for the refund. At this point, it's been a month and I still don't have my money back.

You need to immediately file a dispute with your credit card company. The credit card company MUST remove the charge and they will do what is called a "chargeback" to the gym. The gym will receive a notice giving them so many days to prove the charge is legitimate. If they don't, the charge stays off your account. If they prove it is legitimate, the charge will be put back on. Once you have done this, send a letter via certified mail to the gym's manager. Inform him that you are disputing the charge and have taken action with your credit card company. Inform him that he has 10 business days to fix the problem or you will turn the matter over to the Attorney General's Office. Be courteous, be professional, and be firm. And most importantly, follow through.
