I received a letter from Law Enforcement Systems, LLC notifying I had Unpaid Toll Violations in Miami-Dade County.  Reviewing the letter, I noticed the license plate is not one I own and justly went to the GOMDX website to review the photos.  The photographs clearly show an individual on a motorcycle.

I contacted the debt collection agency to inform them I was not the owner of the vehicle and wanted to dispute the claim.  I explained that I was not a resident of Florida nor do I own, or have ever owned, a motorcycle.  I explained I lived in Georgia and any vehicles I own are registered in GA. 

Advance a few weeks and I received another letter informing me I was in violation and threatened a $500 fee, three points against my driving record and suspension of my driver’s license.    I again contact the debt collection agency to reiterate I was not the owner of this motorcycle and provided the case number from my first call.  The agent stated their record showed the vehicle was mine and I was responsible to paying the fee. 

I continued to explain I don’t live in FL, I don’t own a motorcycle, and I was not the individual they were looking for.  The agent insisted the vehicle is mine and I would have to prove otherwise.  I asked them where they got this information and they stated it was from the state and that is all they look at. 

They stated that I get Vehicle Vessel Report to prove I was not the owner and provide NO assistance in helping resolve this error.  I asked who to contact and all they could say was to get a Vehicle Vessel Report.  I requested to talk with a manager and the agent said she would transfer me to her voicemail.  I explained I wanted to talk with someone directly and she said it was the Manager who told her to inform me to get a Vehicle Vessel Report. 

I started by calling the FL Department of Highway Safety and Motor Vehicles for assistance and the customer service agent was very pleasant and helpful.  I explained my situation and she was dumbfounded by the fact I was call all over for this information on Vehicle Vessel Report.  What they suggested was getting a Motor Vehicle, Vessel and Mobile Home Records Request form from their web site and fill it out.  Unfortunately this comes at a cost of $4.00. 

 

My question is this, why is it not possible for a Debt Agency to have access to these record directly?  Why is it I have to prove the motorcycle and plates do not belong to me when they are contracted by the state?

It is my belief Law Enforcement Systems is trying to make this as difficult as possible in hopes that I simply pay the fee.
