This guy sounds like he's trying to give you the runaround. Why would a shipping company be responsible for him selling you an unfit product? Keep up the legal pressure and don't let him try and weasel out of this. As the seller, he should know which of his products are certified for CA use.

Filed suit and served papers on 12-18-08 Received call from Chris Briden 12-23-08 where he said that he just recieved papers saying that the schooter I got from them is not epa approved and that I am wanting to go to court for it. Long story short this is something we would want to take care right away for you. If it is registration you are having problems with we can easily and gladly take care of it long before the court date. Let me see here there is a court date of Feb. 5th so I see no problem why we can not take care of this long before the court date so please give him a call back I will be here between 2pm and 4pm or after 01-02-09 regarding this matter and that he is sorry for any inconveniece and does not no why it got this far or if I tried to call about this matter before or what so give me a call or you can email me direct at [email protected]. Hope to hear from you soon. I returned his call on 12-31-08 and told him who I was and why I was calling and he replied that there is nothing that they can do for me and that I need to go after the company that shipped it to me. I asked for the name of that company and he said it should be on the bill of lading. I asked him to hold on and looked it up and told him that it says Legion Global/Chauni Inc. DBA Longbo. He replied," Its Longbo I need to get in contact regarding this matter and that I can contact them directly at there web site which is longbousa. I have checked with the Illiniose secretary of state regarding Legions business liciense on Jan.6th,2008 to see if it transferred ownership or not and there has been no change
