I WAS INVOLVED IN A AUTOMOBILE ACCIDENT WITH A LIBERTY MUTUAL INSURED AND MY CAR WAS A TOTAL LOSS. LIBERTY MUTUAL INSURANCE CALLED ME AND SAID BECAUSE I DID NOT AVOID THE ACCIDENT I AM 10% AT FAULT FOR THE COLLISION.

THE ACCIDENT HAPPENDED IN AUGUST AND HERE IT IS OCTOBER AND MY CAR STILL HAS NOT BEEN PAID OFF.

I was in the same situation 5 year's ago in 2003 with progressive. It took two year's to settle the judge was corrupt cause he was friend's with progressive insured. This is conflict of interest but guess what progressive was eager to settle later that day after we told them the judge was friend's with them. There lawyer down right lied about me embarassed me talked down to me. The judge was recording the whole hearing so this will prove how progressive's lawyer treated me like I am not a human being. Well progressive later settled that day & there was nothing that jerk lawyer could do about it. Well it still leaves ma angry how the judge treated me he knew they caused the accident, but he was not going to make them pay anything cause he knew them. It still has me angry till this day. My life was ruined before it even got started. This accident took 5 year's of my life well @ least I can vent my anger on this site. My car was totaled due to one electrical wire that powered the inside of the vehicle. To the OP it's only going to get worse & this will take 5 year's of your life & you will be harassed from your finance company & collection agencies. I hate progressive I hate all insurance companies. Progressive suck's. On top of your other grief you have to put up with people insulting you & blaming you for the accident & they say you deserve all this. It, did get pretty ugly in the hearing with progressive but @ the end but this has left me scarred for life!.

The other party's insurance company isn't working for you, they are working for the other driver. File a claim with your own insurance and they will go after the other driver. Or you can go after the other driver in court for every penny. Usually insurance companies will cry uncle at that point (because defending their insured driver will cost $$$) unless you're looking for a whole lot of money.

It is absolutely against the law and Fair Claims Practices Act of every state to put any amount of liability on a person just for being in an accident. There has to be a legal basis for applying any percentage of liability or negligence against any driver. If you work for an insurance company (I can only assume you are not a claim adjuster) you should not be giving people terribly inaccurate information. Since the original poster didn't include any accident details we don't know why the 10% was assessed but in most state both parties in an accident can be held partially responsible for the accident. It is called comparative negligence and it has nothing to do with putting any responsibility on somebody just for being in an accident.

All insurance companies are like this. It's your fault they do this to get out of paying you for damanges caused from there insured driver. Insurance companies do not care if you lose you job get your car repossed or pay for your medical bill's or if your credit get's ruined. All insurance companies work togather to protect each other. Don't other complaining to the insurance commissioner office they do not care about us. They all try out of getting paying a fair settlement they defraud you & try everything to screw you more. To make matter's worse collector's are harassing you to pay medical bill's which you cannot pay due to there stupid insured but they have nothing to worry about, they can go on living & not worrying about your problem's that they caused!. This really tick's me off even if the insurance company accepted responsibilty for there insured causing accident & blamed them for it, but they still do not want to pay for all your money. In the meantime your car get's repossed cause of there insured's fault, & you are out of work threw no fault of your own but they don't care. Insurance companies love screwing people over. Why, should we have to pay the price for what there insureds caused!. We should be able to sue for pain & suffering & make them pay for a new vehicle for how there insured took it away from us. The insurance commisioner office does not help either, they screw us more to & make matter's worse.

I work for Liberty Mutual and can tell you that Liberty Mutual is not the only insurance company that would have found you 10% at fault. I just found out and was shocked to hear that no matter what, if you are driving your vehicle and are involved in an accident, you are automatically at least 5% at fault. Other factors play into higher percentages, but even if you are not ticketed or think that you could not have controlled what happened and the other party even admits fault, you will be at least 5-15% at fault for the accident. So please, do not slam a company as great as Liberty Mutual for something that is used industry wide. I say this as a customer and an employee at Liberty Mutual...I would never work for or insure my vehicles with any other insurance company.
