Tierra del Sol in Orlando must surely rank amongst the biggest scandals in the history of MRI Overseas Property. Hundreds, perhaps thousands of purchasers, held in limbo for years, having purchased at Tierra del Sol, or one of its two sister developments next to it.

MRI as a TRANSACTION BROKER, must abide by The 2008 Florida Statutes:

(2) TRANSACTION BROKER RELATIONSHIP.--

(a) Transaction broker-duties of limited representation.--A transaction broker provides a limited form of representation to a buyer, a seller, or both in a real estate transaction but does not represent either in a fiduciary capacity or as a single agent. The duties of the real estate licensee in this limited form of representation include the following:

1. Dealing honestly and fairly;

2. Accounting for all funds;

3. Using skill, care, and diligence in the transaction;

4. Disclosing all known facts that materially affect the value of residential real property and are not readily observable to the buyer;

5. Presenting all offers and counteroffers in a timely manner, unless a party has previously directed the licensee otherwise in writing;

6. Limited confidentiality, unless waived in writing by a party. This limited confidentiality will prevent disclosure that the seller will accept a price less than the asking or listed price, that the buyer will pay a price greater than the price submitted in a written offer, of the motivation of any party for selling or buying property, that a seller or buyer will agree to financing terms other than those offered, or of any other information requested by a party to remain confidential; and

7. Any additional duties that are mutually agreed to with a party.

(b) Disclosure requirements.--Duties of a transaction broker must be fully described and disclosed in writing to a buyer or seller either as a separate and distinct disclosure document or included as part of another document such as a listing agreement or agreement for representation. The disclosure must be made before, or at the time of, entering into a listing agreement or an agreement for representation or before the showing of property, whichever occurs first. When incorporated into other documents, the required notice must be of the same size type, or larger, as other provisions of the document and must be conspicuous in its placement so as to advise customers of the duties of limited representation, except that the first sentence of the information identified in paragraph (c) must be printed in uppercase and bold type. This paragraph expires July 1, 2008.

Have MRI complied with their duties as a transaction broker, whilst still actively marketing the Tierra Del Sol development? According to the website of American Leisure Group Limited, ALG's shares were suspended from trading on AIM on 30 June 2008.

Furthermore, also according to the ALG website, in view of the continued uncertainty as to the financial position of the Group, the suspension has not been lifted by the LSE and the LSE will cancel the admission to trading of ALG shares on AIM at 7.00 a.m. on Friday 16 January 2009.

Finally, according to the ALG website, "As previously stated, ALG needs to secure new facilities to continue trading."

The lawyers of MRI have forced the deletion of many website posts. Let us now see how long they continue to market this development.

Check out the posting on www.news.cyprus-property-buyers.com. There had been rumours that Darragh MacAnthony is no longer Chairman of MRI, but this article by Dominic Pickering, the new CEO, denies that. Michael Liggan and Wendy MacAnthony have set up DCC International Properties - as these people were prominent in MRI, I wonder if they will have the same appalling customer service and will treat customers and staff as badly as MRI apparently have. Update - the NAEA/NFOPP found MRI guilty on various counts. They stated 'The tribunal were appalled to hear of the Company's misleading business practices, including unfulfilled promises of guaranteed rental returns and misleading descriptions of the facilities that would be available to owners'. This is a brief summary of what was said. Obviously people who have had the misfortune of buying from this company know just how bad things are and that what they were told to persuade them to buy property from MRI turn out to be untrue.
