The aboved named company and idividuals hired me to drive their trucks over the road. After doing so and continually doing road side repairs to trucks they refused to pay me or pay me for the mechanical services that would have cost them several hundred dollas each time if we had called for roadside service.

DO NOT do business with the above mentioned names!

Magann Atlantic is an "OWNER/OPERATOR" type trucking company. This specific designation means that an owner-of-a-truck not only leases on to Magann Atlantic, but also drives the truck. An "OWNER/OPERATOR" is an "independent contractor" who, basically, has his own business. In other words, Magann Atlantic does not own any trucks (thus it follows Magann Atlantic can't employ drivers). Two truck owners leased their trucks on to Magann Atlantic. Because these truck owners did not want to or could not drive their own trucks, they hired a driver...in this case, Junior. It is they who were, by federal law, responsible for paying Junior and for filing a 1099 for Junior's pay...not Magann Atlantic. Junior took Magann Atlantic to trial at which time the judge explained to Junior that he, Junior, had no relationhsip to Magann Atlantic; that he, Junior, was employed by the trucks' owners with whom he did have a relationship; and that Magann Atlantic was not responsible for any payment Junior thought that he should receive. Junior has been in the trucking industry for a while. He knows very well the difference between being an O/O (Owner/Operator) and a driver for an O/O. He has slandered and, now with this written complaint, libeled Magann Atlantic....both serious and litigious offenses.

As of 4/14/2005 these companies still have not acknowledged that they owe the driver the money that is owed him. Upon further trying to obtain 1099 forms they do not return or acknwledge that they recieved contact by phone or by in person contact that they have these forms.They claimed whentaken to civil court that driver was never employed by any of the 3 companies.
