I HAD A CAPITAL ONE CARD AND I GOT IN FINANCIAL BIND,SO I STOPPED PAYING ON IT. IT WENT TO COLLECTIONS AND MARCADIS AND ASSOCIATES PICKED IT UP. THEY HAVE HARRASSSED ME FOR EVER. WELL NOW THEY HAVE SENT ME A LETTER REGULAR MAIL NOT CERTIFIED TELLING ME I HAVE TO SEND THEM ALL OF MY FINANCIAL STATEMENTS WITHIN 20DAYS OR I'M GOING TO JAIL OR MY WAGES WILL BE GARNISHED AND IT IS SIGNED AND APPROVED BY A JUDGE IN JACKSONVILLE. FLORIDA. WHAT CAN I DO ? I NEED ADVICE?

Marie, I hope you saved that letter. If you did, you can use it to get that lawyer disbarred. File a complaint with the Bar Association IMMEDIATELY!! And file a complaint online with the FTC for the BLATANT FDCPA violations. You can get paid on these violations if you are willing to sue them. FYI You CANNOT go to jail for any bad debt. There is no debtors prison. AND, they cannot even threaten wage garnishment! They MUST first sue you and win to get a judgement, then get a garnishment order signed to get your money. Most likely, Capital One is no longer involved, and these bottomfeeders are representing a JUNK DEBT BUYER. And, there is no legal requirement for them to send the request by certified mail. However, this works in your favor as it proves their claim is not worth the 5 bucks for a certified/rrr letter! Never speak to any debt collector/debt lawyer on the phone. And ignore everything but the summons. Is this a letter, or is it INTERROGATORIES? You should check to see if they actually have a default judgement against you. These lowlife are famous for "sewer service" of summons and getting the quick default judgement when you fail to respond. You need to check court records and your credit reports right now.

the only time a collection agency can rightly request a financial statement if a judgement was entered against you. collection agency CAN NOT takt money out of your pay without a judegment. first when did this account default? Florida has a 4 year ststute of limitation on open accounts, that is what a credit card is. if this ever goes in from of a judge, make sure you file a counter complanit. send them a letter(RRR) for vaidation and in your letter place, that you do not want them to call you on any telephone anywhere at anytime, use only the US Mail This paper that is singed by a judge, is there a case number on? look up the clerk of courts and see what was entered a judgement and get copies of every thing. where you send a summons? appeared n court over this for anyreason thes are the thinhg you neednto put out here for a better picture of how to help, is this a real judge that signed the paper
