On 1/28/12 I went to Sansone Auto Mall on Route 1 in Avenel, NJ to just browse the cars I was not intending on purchasing one however; I felt obligated and pressured into buying a 2007 Mazda 3 S touring car. The finance on the car was @ 6.9% The car was priced @ $13,491 and after all taxes fees and warranties were added the total of the car was $ 23,441.38!!! I did sign a promissory note to give a $3500.00 down payment on 2/10/12 which I told the finance guy Gene I don't think I would have it and he looked at me strange and said well call me and maybe we can work something out. I still have not given it to them. If I was to give the down payment this would make the Finance amount $19,941.38. the loan was for 6 years which means if I keep the loan for 6 years I would be paying $27,980.00 this is including my $3500.00 Down Payment! (I realized this days later). It was late at night, they were closing, everyone was tired and they never went over the paperwork with me, they were just printing papers and throwing them at me to sign. My Father was with me and we both felt the transaction was rushed and I was felt very pressured into signing this contract. He will contest to that. If this is not a rip off I don't know what is! They told me to take the car home without the loan approved, without the down payment and without insurance! My Father and I said are you for real? All they took was a copy of my license. How were they able to let me leave with this car to begin with?

After thinking about it and speaking to people I was advised to look over the contract and all the papers again after reviewing the papers and contract on 1/30/12 I noticed all these totals above as well as discrepancies in the extended warranty and the contract one of which I was charged $299.00 twice for window etching. and the price of the car that was originally $13,451 was now priced at 16,380.00 on the contract.

I went back to the dealer on 1/31/12 with my father and with the intentions of giving the car back due to the high price and because I felt I was being scammed I asked Gene the (FI guy) to explain everything he was very rude in doing so, losing patience with me because I couldn't understand what all the numbers and charges meant. I kept saying "how could the loan balance be so high on a $13,000 car". How am I ending up paying $28000.00 for this car! He said no don't look at that price look at this price you paid only $16,000 for the car I said no! I am paying $28,000 for the car! at this point I was getting very emotionally upset. once again feeling I was being pressured into signing a second contract.  The finance guy Gene was saying to me you need to stop listening to all these other people! you got a great deal! I said no, I didn't! He said yes you did but because you are listening to these people trying to turn you off to the car you think you didn't! but you did! I once again I got very emotional I was distraught and very confused by this time not knowing right from wrong up or down or what was going on I under a lot of distress. The Finance guy Gene didn't care at all about how or what I was feeling! All he kept saying was "it's a great deal" "sign it," I have to go I have a Baby I have to get home too", I said "yeah so do I"! So I just couldn't take the pressure anymore and I signed it!!!! I should have just handed him the keys and left but I was just so confused and couldn't think straight. Instead I let them do it to me again, I let him talk me right back into the car. and once again I went home with the second contract!

For the next couple days I worked late and was trying to get advice from people and dealers about what to do next I even went to Toyota here on Staten Island and they said it was a bad deal!

Finally on 2/3/12 I went to my friends boss who is the owner of Honda here on Staten Island after going through all the paper work from Sansone and speaking to him and his FI guy (who use to work for Sansone) they both agreed and told me it was a very bad deal, saying and i quote.... "they buried you"! They say the car is only worth about $8,000 on Kelly Blue Book! As he (The Honda  Owner) was looking through the contract he said "you have the loan with Wells Fargo"?  I said "No M&T Bank". He said "no it says Wells Fargo". I was never told the bank was being switched to this bank. I was never told I was even approved for the loan! As we looked through all the papers, All the other paperwork say M&T Bank on them he told me to bring the car back! That it didn't seem right! Everything is written wrong! It was too late to bring the car back On Friday 2/3/12 by the time we were done.

Saturday 2/4/12 I had to work late by the time I got off work Sansone was closed Idid not go on Sunday 2/5/12 because Sansone is closed on Sundays.

I went to Sansone on 2/6/12 to bring the car back I was accompanied by two very close friends who came with me thinking we were just going to dropped off the keys. Very rudely Gene from (Sansone) told me that the loan was already funded I said oh yeah when he said today! 2/6/12 and they were already paid by the bank... I asked how could this be if I did not give them the down payment, any income information or even fill out a loan application? they just became very ignorant towards my friends and myself! I told them the Sales Manager and Finance guy I don't want the car! and the sales manager got very verbal and the first thing out of his mouth was "Well, I am not willing to un- wind (Cancel) the deal". He didn't even try to help with the Situation! My Friends stated Well she does not want the car! She can't afford the car! and You took advantage of a single mother! and he said again " Well I'm not un-winding the deal" go  take it up with the bank now it's no longer my problem. They started to argue with my friends this is no way for them to treat people or conduct business. They know what they did to me!

I then contacted the Wells Fargo bank and told them everything that went on here..... They told me they could only cancel it if the dealership (Sansone) would agree to cancel the loan! They stated they would call Sansone and call me back however they never did! I ask how they could have even fund $20,000 on a used 2007 car. I believe this bank is in cahoots with this dealership and they just rip people off they don't care about mine or anyone elses situation! The loan was not even paid a day they could have easily dissolved it and chose not to because they made ALOT of money off it.
It just not right how they can do this to people and get away with it!

I don't know what to do next there is so so so much more to this story everything seems wrong! I even got charged for a destination fee! Is this even legal on a used car? Please Please Please help!  :'(

Let me set the record straight...... The car I financed had already been funded and I had the car 2 weeks (while fighting for Mazda to un-wind the deal) which they wouldn't since it was funded already! I called wells fargo and they verified it was indeed funded! after a week fighting with Mazda, calling the BBB, the Credit Union and personal Contacts within the car business I was finally able to meet with the Vice President of Sansone! I cried my eyes out stating the car was a 2007 and in 6 years it would be 11 years old and after the finance I would be paying $30,000.00 for it! Told him how rude his Mazda sales people were how they left messages at my job and on my cell phone impersonating the Woodbridge Police! saying I owed them $3500.00 for Down payment and had no insurance on the car! and If I didn't call Sansone they would put a warrant out for my arrest last Monday! After about an hour with the vice president of Sansone we came to an agreement and I have to tell you... HE DID NOT HAVE TO UNWIND THE LOAN but he did! Not only did he unwind the loan he even paid all the penalties to do it! He took the car back and did not charge me for any miles I used! he did not charge me a dime! I told him I would rather lease a car at this point! He told me I could have any car in the lot I did not have to get a Mazda! So I picked the car I had my heart originally set on! I am now leasing a BRAND NEW Toyota Corolla LE in white and only 15 miles on it which 5 of them are my test drive! They also threw in the 3 years maintanence free of charge gave me a $750 dollar rebate and my payments if you need to know are only $289 a month and after 3 years if I decide to keep it I only pay 10K  for a total of $21K the price of a brand new car! instead of $30k for what would be an 11 year old car! So If this makes me an A$$hole then so be it! I now got a great deal! and the car I wanted! Why don't you try to get a loan unwound after 2 weeks and see how far you get with your attitude kindness does pay off! and thank you to those who agreed with me :)

And I *commend* (not condemn, as some of you are) the fact that the OP is now recommending them. She is obviously able to afford the lease payments, and the car dealership had no obligation to work with her. Is the lease the best deal in the word? Probably not. So what? The dealership makes money, and the customer is happy. What more do you people want?

This place saw you coming.....packed the loan and pissed all over you while telling you it was raining, and now you're recommending them???  Get a life.  They didn't want the hastle or cost of a voluntary repo since no money exchanged hands yet.  Once these guys get their commission they could care less for the car, loan or you. ...So they fleased you with a USED car-good going 'NOT'.

"I felt obligated and pressured into buying a 2007 Mazda 3 S touring car."

There was no reason for you to fell obligated to purchase anything. If you continue to permit sales reps to pressure you then you are in for a lifetime of disappointing purchases.

You failed to do your homework before the sale. You requested advice from others after you agreed to purchase the vehicle. If you had done your homework you would have discovered that every version of that car sold new for less than $20000 in late 2006.

Enjoy your Mazda.

How is it, and what if?

Thank you for replying and trying to help Flynrider..... I know I didn't sign any loans only the contract, I never gave any financial information, no pay stubs, no w2 not a dime! All they took was a copy of my License and my SS# I drove the car off the lot without giving them any kind of insurance information and no money down just a promissory note I was told a loan was approved and was baffled on how when I didn't disclose any financials to them.... After leaving the dealership with this car that had no insurance and paid no money for seemed strange a few days later after speaking to people they suggested I look over the contract this is when I noticed the high price of the long term loan. I also noticed I was double charged for the window etching. "well you know the whole story from reading it" anyway the bottom line is We have called wells Fargo and asked how the loan was even approved if I didn't sign a loan application. Heather (from Wells Fargo) stated "well you had to sign something" I told her all I signed was the contract she said that is all they needed. Is this true? I also asked how they approved the loan without the car being registered since I didn't get insurance on it. She said she was going to call the dealership. About an hour later Sansone called my job and left a message with my receptionist saying to contact them that they had the Woodbridge PD there. why would the police be there? later on I got a message on my cell supposely from someone who says he was "detective hmmm Sergeant williams martin from Woodbridge police dept." and that I need to contact sansone because I owe them money and am driving their car with no insurance. and if I don't contact them he will issue a warrant for my arrest on Monday. Can they do this? If the loan supposely went through which everyone is saying it did then how is it still their  car? Can it be Sansone impersonating the police? Could this be my way out if I don't get insurance on the car? because if they can't register it then the loan should never be approved, right?

Time to get an attorney involved

#11General Comment

I think at this point if they are threatening police action you should get an attorney involved.  Someone who can review the contracts and can advise you legally on what exactly you are liable for on the basis of what you signed.  They can also help to extricate you from this deal, if it can be done.

I am sorry to hear you felt pressured to sign the paperwork.  Now is the time to protect yourself by spending the money on a lawyer who can help you.

Good luck

The problem

#12Consumer Comment

Sat, February 11, 2012

The problem is that you are apparently willing to sign anything that is put in front of you.   As it stands, the dealership has a contract that you signed, agreeing to buy the car for that outrageous amount.

" It was late at night, they were closing, everyone was tired and they never went over the paperwork with me, they were just printing papers and throwing them at me to sign.  "

Any chance one of these was a loan application?   It seems likely, as the bank would not have approved of a loan without one.

"  I even got charged for a destination fee! Is this even legal on a used car? "

They can charge any fee they want.  As long as you agree to pay the fee, it's legal.

" They told me they could only cancel it if the dealership (Sansone) would agree to cancel the loan!  "

Assuming that the bank has your signature on the application (which I think they do), they are correct.   This is now between you and the dealer

The bottom line is that you walked into this dealership and signed a contract to buy a really expensive used car without looking at what you were signing.    This is what sinks most people and makes a lot of profit for car dealers.   Whenever you sign a contract, you are bound by the terms of that contract.   There are no "do overs" where contracts are concerned.

This will be an expensive lesson in what it means to sign your name to things without reading them.   You'll either be stuck paying for this car for the next 6 years, or you can refuse to pay and they'll repo the car.  The car will be resold for a cheap price at auction and you'll still be responsible for paying the bank the difference between the auction value and the amount you borrowed.  You'll also have a repo on your credit report.

I strongly suggest that neither you nor your father ever set foot on a car lot unless you are in the company of someone who knows what they are doing.

I just purchased a used car and don't want it I have been trying to get Sansone Route 1 Auto mall in NJ to take it back! I feel I was taken advantage of and am paying way to much for the car...... I don't know how the loan went threw when I didn't disclose any financial information I never signed for a loan only the contract. I did sign a promissory note to give a $3500.00 down payment today 2/10/12 which I didn't give because I am trying to fight and have them take the car back! I never
gave them a dime and I still did not put insurance on the car so how did the loan go through if the couldn't register it? No car payment are due until March Can you please give me some advise I think they even left a message impersonating the police saying I need to contact Sansone because I have THEIR car and owe them $3500.00 and have no insurance on it and if I don't contact Sansone they will put out a warrant for my arrest on Monday! Can they do that? I really don't want this car!

Supossely the loan went threw and they say they were paid so how at this point could they say it's their car? Please help?

Thanks
