On August 1st I was hit from the back sitting at a stop sign ... Mercury Insurance ... my Insurance then said it was my fault !!! But could not explain why ???????? I was asked to pay a $500.00 deductible. and I was given my first point with the DMV !!! Mercury Insurance never tried to answer the question why I was at fault ???

Your insurance company doesn't give you any points against your license.  Law enforcement does.  So it must be the police who are charging you with a violation.   What was the charge?  Also, if you filed a claim with your insurance company, they will always require you to pay your deductible.  If they recover it from the other person's insurance it will be refunded to you.

This is a very good clue to the mystery.    You see, insurance companies do not put points on your license.  Only courts can do that when they've found you guilty of an infraction.   This would lead me to believe that the answer to your question is in the citation you were issued that ultimately resulted in points against your license.

If there's a point, now on your DMV record, it almost certainly came from the ticket and not your insurance company.

Before, you get into a legal battle with them, look into what I've posted above.

If you WEREN'T cited for the accident, then your insurance company indeed may be in the wrong.
