Mercury Insurance/Bill Smaldone, Mercury, lied to me about repairing my car, paying rental car and medical bills Clearwater Florida
On September 10, 2002, I was hit by a car that ran a red light. A police officer was turning eastbound on the corner of the accident and witnesses the accident. The other party was ticketed. I had my car towed to the dealership, the dealship then towed my car to a body shop.
This is my first accident so I wasn't prepared for what happened next.
I called my insurance company to report the accident.
The body shop said the other party insurance,Mercury will pay for all the damages. Bill Smalldone from Mercury insurance talked to me several times and told me don't worry about anything they will pay for the rental and car repair and any out of pocket medical expenses. He also left several messages
on my recorder to verify that they were paying medical and fixing my car(I still have the recorded messages).
Needless to say the car cost approx $12,000 to repair.
After 2 months at the body shop, Mercury says it is over their clients limit and pays nothing on the car. Nothing on my medical bills and I are stuck paying a car rental.
My insurance,Nationwide would only pay $9,000 because their policy reads they will pay for used parts only. If my insurance would have taken care of the repairs, they would require the body shop to only put used car parts on my car so therefore, they will only pay for used parts.
Mercury SUCKS!!! They deceived me in believing they would pay and not to worry about anything. I had pay approx. $3000 to get my car back for an accident that I did not cause.
Bill Smaldone from Mercury Insurance told me lies. Their client was ticketed for running a red light and paid the ticket. Mercury Insurance told me they were responsible for the expenses and let the body shop run up a bill and when the car was done, Mercury Insurance refused to pay!!!!!

What Mecury Paid out.. I hate to see people get ripped off, but the one aspect of what you reported that I would like to address is the limit that Mecury Paid to you. In the State of Florida (I am a licensed Florida Insurance Agent), the minimum for Liability is 10/20/10, or $10,000 for bodily injury or property damage maximum per occurence, and $20,000 maximum in the policy year. If the person that hit you had minimum coverage only, the most you would receive total is $10,000. That is why Insurance Companies offer UNINSURED/UNDERINSURED Motorists coverage. I recommend to all of my clients that they carry this coverage. As vehicles go up in value, minimum limits are legal in Florida, but not adequate. Legally, as Florida is a no-fault state, your own Personal Injury Protection coverage (PIP) should cover your medical bills. Good luck!

Many car dealers do not have Body shops within their facilities, and when they do have them they may be leased to a "third party" and when they are outside their facilities, it is most likely that the body shop is own by a third party also, and the car dealer will not assume any respossibility or liability for any and all problems you may experience there after, including , overcharging, poor repairs to your vehicle or waranty the repairs, this is because it is possible that the body shop is givin a good "deal" to the dealer in return for job referals, about mercury insurace. THEIR BUSSINES PRACTICES ARE UNORTHODOX, THEY ARE SORE LOOSER, THEY WILL FIGHT HARD AND USE ANY SCHEME IN ORDER TO SAVE A DOLLAR OR EVEN .50 CENTS
