Complaint Review: Michael Scott Terry - las Vegas Internet

As previously stated in my initial Rebuttal to "Dave" Brin on May 21, 2013, I was initally contacted by him in late Fall of 2012 to hire him to produce and mail out targeted advertising flyers to distressed homeowners in Las Vegas that needed assistance with refinancing and bankruptcy.    He represented that he worked with Martin Sullivan, the owner of a local print shop called Chapter One/Package Plus Printing and that they would produce high quality advertising for a reasonable fee. 

On January 11, 2012, I contracted with Dave Brin to produce Spanish language flyers to be mailed out to targeted zip codes in the Las Vegas metro area and paid him $740 to do so (see attached Invoice + Advertising Agreement).   In reliance upon our agreement, I hired on a part time basis 2 legal assistants and installed a custom phone system to handle the anticipated new business that would be generated from the contracted for adverstising. 

By early March of 2012, after not having heard from him that the flyers had been mailed out, I began a long and frustratingly unsucceful attempt to contact him on his cell phone, the only way I had to reach him.   In late April of 2012, he contacted me out of the blue and aplogized for his dissappearance and he reaffirmed our contract.  He stated that due to his own  financial difficulties, he was uncertain of exactly when he would have the flyers mailed out, but that he was condident that he hoped it would be soon.    I acknowleged that he felt confidend he could soon mail out the flyers and I infomred him that I had already hired 2 part time legal assistants and installed phone equipment to handle the anticipated new work flowing from the advertising. 

Between the April 2012 conversation and early May 2012, he did not communicate with me at all to advise of his progress.   Then in early May 2012, he called once again out the blue and told me that he had received a large sum of money and that the contracted for advertising would be mailed.   I acknowledged what he told me and replied that I was anxious for him to perform under our agreement because I had already hired 2 part time legal assistants and needed the advertising to be sent our as soon as possible.    That was the last communication I had with Mr. Brin (see attached June 6, 2012 Demand Letter).     

After the May 2012 phone conversation, I once again began a futile series of atttempts to communicate with Mr. Brin by leaving phone messages and going to his assocaite's print shop.   In my last voice message to him and also conveyed to Mr. Sullivan, I advised that if he did not perform under the agreement by a date certain I would be forced to seek the return of my money in Las Vegas Small Claims Court.   

Shortly thereafter, I was alerted by a legal collegeague that Dave Brin's report against me on Rip Off Reports had been filed in which Mr. Brin complained that he had consulted me for self-help bankruptcy services and that he had lost his home becuse of advice I had provided him.   Moreoever, he claimed I had made sexual advances towards him.    I was and am disgusted and sickened by his accusations.    Mr. Brin was so elusive and evasive that I was unable to have him personally served with service of process of a civil claim for the return of the monies I paid him.    

In searching Rip Off Reports, it appears that Mr. Brin has also absconded with another Las Vegas business owner's money in identical circumstances to mine.  For further information, see Rip Off Report #998886 (Complaint Review :  Chapter One Design, Print and Marketing).    In that case, the business owner was also contacted by Dave Brin and paid for advertising services which were never delivered.    In my case, not only were the contracted advertsing services never in fact delivered, but, when I was forced to complain to Mr. Brin and demand the return of my money, he defamed me in a permanant manner intending to cause me harm by falsely making reprehensible and damaging accusations.     

In Summary, I was the individual who was ripped off by Dave Brin, because of when I tried to demand from him the return of my money due to his breaking our written agreement, he filed a Rip Off report against me and alleged defamatory information in a permanent form.   Very Frustrating to say the least !!

In response to Dave's accusations regarding Mr. Terry's  personal and professional conduct I would like to refute all of his allegations. You Dave have no right to say such outlandish and ridiculous things about Mr. Terry.

I have personally known Mr. Terry professionally and personally for over twenty years and he has never been guilty of any of the things you claim he is.

After reading your letter I have a stronge suspicion that you Dave must be the closeted homosexual and was in fact attracted to Mr.Terry and when he being straight as and arrow rejected you, you resorted to posting such a childish and immature posting.

Having many homosexual friends myself I have seen such idioatic behavior before but they would never accuse someone of being a closeted straight man;how homophobic you are.

Mr. Terry has always had his fair share of women begging for his attention. He has an outstanding academic background and is a perfectionist when it comes to his work.

He has never been " fired" from any of his past employers, he has moved on to higher and better opportunities. Mr. Terry is happyly married with a beautiful wife and children, why would he give that up for you? Are you that wonderful?

You are a petty little man Dave and should grow up and accept your failures in life instead of blaming others. If you lost your home the only one to blame is yourself and your poor ability to manage your finances. 

"Dave", to begin, I do not offer "self-help" bankruptcy services, I offer reasonably priced Chapter 7 and 13 bankruptcy services for consumers in financial distress.    Had you needed "self-help" or other low income assistance, I would referred you to Legal Aid Center of Southern Nevada.  I do not take on low income cases.   

As to your statement about losing your home, well, if such had really occurred and it was not your intent to lose the property, rather than merely surrendering the house in the bankruptcy proceeding as many people do, then such an error is malpractice.   If such had really occurred, I am quite certain I would have heard about it at the time, not years later on this website.  

As for me having been terminated at previous positions, simple common sense would indicate that you do not know for whom I have worked throughout the USA over the years, let alone the employment status of each position.   Finally, as a rule, I do not socialize or have friendships with my clients, ever.   If you misperceived something which did not occur, perhaps you are the individual who has issues with his sexual identity and prefernces.  On the other hand "Dave", I am happily married to my wife of 10+ years with 2 children.      

Lastly "Dave" if you are so disgruntled about the legal services you allegedly received, I would welcome the opportunity for me to make it right for you.  Please call and make an appointment.  I am quite confident you will not do so, as you never were a client to begin with, rather, you were a vendor that failed to complete his contract, and, when I sent you a demand letter to do so, this complaint apeared at the same time, imagine that...
