MTC agreed to purchase 3800 hard drives at $23.50 each and supplied a hard copy purchase order signed by an authorized buyer. When the freight departed for delivery to MTC, they began to dispute the price claiming they now wanted the drives for $20.00. We refused the price discount but offered to stop the shipment and allow MTC to cancel the order with no restocking fees or financial obligations what so ever. However, in lieu of controlling the market on the drives because they had 11,000 in stock already, they opted to proceed with the purchase and accepted the delivery of the drives.  To date they have not paid us a penny for this $89,300.00 worth of product and will not return them to us.

This was our third large hard drive deal with MTC and the ongoing agreement was 90% wire transfer and 10% company check upon receipt. Although they did not uphold this on the first two orders, they did pay in full within a week therefore, we trusted them with ongoing business. Our 3800 hard drives remain in ransom upon acceptance of a lower price. We have approached their facility with law enforcement in attempt to retrieve our drives yet MTC refused to release them so we obtained nothing but a report for our future civil court filings.

This massive corporation known as a top 108 by VARbusiness magazine and an industry leader selling over 300,000 hard drives per month, has now financially harmed our small business. This is unjust theft and they are getting away with it.

As the previous rebuttal clearly states, the businessof MTC is primarily arbitrage of electronic components. Although, we are no longer one of the largest purchasers of hard drives in the world and no longer considered asa Top 500 VAR, we are still the #1 privately owned gray market products reseller in North America with the vast influence to assist to proliferate markets for all manufacturers of hard drives and thosecompanies who are loyal to conducting business with us.These productsmay encompass Out of Warranty items resold with MTC warranty, Refurbishedproducts purchasedfrom various regions ofthe world to be resold as new,and overstock from various sources. At this level business, there are basic understandings for all who participate. We are innocent of any accusations which haveresulted in numerous lawsuits by partners/clients and blacklisting by a couple of manufacturers. If the originator of this complaint understood this segment of the IT industry, i.e. working with component brokers, this baseless complaint would never have arisen. Aside from the Purchase Order, there have never been a written agreement between our two respective organizations that the order is non-negotiable. And, we are confident that any frivolous lawsuits...such as this case...will be dealt with favorably for MTC.

MTC participates in arbitrage of Electronic Component commodity items on a regular basis. In lieu of these mentioned items there are many variables, circumstances, and a mulitplex of extenuating circumstances that can happen when in dealing with commodity items. In the above mentioned circumstance the originator failed to deliver in full the mentioned purchase agreement. They claimed to have controll of the material in full! This was a lie and not the case. They claimed to be able to deliver in a timely fashion mentioned verbally, and on the purchase agreement. This scenario noticed a very tardy delivery. More than 30 days tardy. All who participate in Electronic Arbitrage know certain items only de-value. Rarely do we experience a situation when prices go up. They do, but very rarely. In this case the items mentioned in our agreement, started to rapidly de-value. Another problem this vendor had was delivering the full quantity in which they agreed. It was agreed by both parties, a certain quantity to be shipped. They breeched the agreement a second time by quoting the same material to our customers. This was also agreed not to happen. They created competition in the channel. In the beginning of the deal this was promised not to happen. Why dont they mention these particulars in their complaint. They also failed to mention they were paid in full on all invoices, minus 60-80 defective units. This complaint is slander at best! Perfect example of a company trying to participate at a level they are not used to dealing in! We won't mention their name as it suits no purpose. If you have hard drives for sale please note, MTCUSA.COM buys more drives than almost anyone in the channel! Good day to you all!
