In the state of texas they have only 4 years to take you to court ( no matter what they say). If the debt is 6 1/2 years old, Then it will come off your credit report when it becomes 7 years old.

I am confused about this legal documentation I have recieved from Midland Funding it does not have a Judge's name and the date that it was filed was back in October 2006. I have to respond by 10:00 a.m. Monday next following the expiration of twenty days after I was served. It states that it was issued May 15, 2007 but I did not recieve until May 29, 2007. Do I have until May 29, 2007 or the 15th? ELIZABETH NEU who states that she is an employee of Midland, states that she has the account and finanical information concerning Midland credit Management and that I have failed to make payments on the account. The document also states that Exhibit A shows that I owe $1543.96. How do I fight this? I have never financed anything through MIDLAND. The credit card debt that I had was through Discover and it appeared on my credit as a charge off. How do I write my response? What do I need to say but make sure that can take my statement and turn it around to benefit them?
