I sold a car about 3 years ago and it was towed two weeks later to Mikes garage. He knew I sold the car because I rented an apartment from the owner and it sat in my front yard for sale. He said that I owed him for towing and storage because it was still in my name. The man I sold it to went to jail and never put the car into his name.

After some time I went to the owner and asked for an itemized bill so that I could start paying on the bill but I was never given a bill. I just tried to get a car tagged three years after this incident and their is a wrecker lien against my license for this so called bill.

I was under the impression that he didn't want to get paid because I never recieved a bill and I rented an apartment with my boyfriend for most of the time over the past three years and never heard a word spoken about it. The new title that he has says that he is destroying the car.

If he never could give me a bill why do I have to pay? Why do I have to pay if I sold that car anyway? I was naive and never got a bill of sale but, I do not think I should be responsible for this. His daughter does all of his paperwork and she is not a very nice person, to anyone. She even has complaints filed against her behavior!

I realize now that, I was responsible for this bill and I should have never filed this report. I was foolish for listening to my so called friends who directed me to this site. I really never knew about the lien until I tried to get a car registered and it came up at the tag office. I owned one car for several years and this circumstance never arose.

As far as the owners of this business go, they have some really huge hearts! I have been renting from them for the past couple of years and they have been so good to me! I had a life threatening medical scare last year and the year before that! I know more about them now and they are more understanding than anyone I have ever had to do business with! I have had problems with my vehicles and they were right there for me when I had no money! I say "they" meaning, the whole business! The owner and all of his daughters, as well as his drivers and mechanics. They have even helped my daughter when she broke down and was completely hysterical because she had no money right away!

Please, overlook my original complaint because I was mislead and have grown up a lot since then! call them for any towing or mechanical problems and you will be pleasantly surprised! Thank you, Lori

It just so happens that this Lori, is the ex-girlfriend of one of our old employees.....sounds like she is looking for a little bit of revenge. Lori never rented an apartment from us, she shacked up with our employee who was living in one of our rental houses...Second, No one told her that we didn't want to get paid, Lori never asked for a copy of the bill, if she had one would have been provided to her....Third, it is the seller's responsibilty to make sure that when you sell a car, you either get a bill of sale or be sure the new owner re-title's the vehicle is his/her own name. Lori plainly says that she sold the car, it was her responsibilty to make sure the transfer of title took place. Fourth, Florida State Statute 713.78 is a statute set forth to allow towing companies to place leins againt the owner of record's registrations in order to obtain payment for services rendered when an owner of record abandons a vehicle at a tow yard without paying for it.....Fifth, a person may not be very nice in another person's eyes when that person does not want to take care of their financial responsibilities. Why exactly did it take her three years to try and registered or renew another vehicle if she never knew she had a bill?????? Sounds like an irresponsible, disgruntled person, looking for someone else to blame besides herself....

there are always going to be problems with any industry. in this case it seems the the so called victum did everything wrong. if you do not transfer the ownership by title in the state of florida then the department of motor vehicles find the seller as the legal owner, making them financially reponsible for the a portion of the cost of towing storage and administration charges. the lien amount is set by the state of florida and in a portion of the total bill. the state of florida will not place a lien on an individual unless the towing service follows strict guide line. one of which is that the towing service sends certified mail to the registered owner. i repeat the towing service must send a cerified letter, it doesn't say we have to deliver it, that is what the uniteds states post office is suppose to do. if you aren't home then the postman leaves a yellow note for you to come to the post office to recieve your cerified letter. no towing service will accept a partial payment on a lien amount. don't forget the balance of the bill, some companys dont collect on the balance and some do, which is perfectly legal there is also a requirement in the State of Florida that if you move you are required to change your address for your drivers license and your vehicle registration, so you can recieve a cerified letter. why do we see more people ignore the rules laws and regulations set down by the state of florida then cry for help. by state statute towing services are required to how a vehicle inexcess of 35 days. owners of new cars pickup their vehicles, the older cars are left at the towing services then end up in a junk yard. so before you throw stones make sure your house is in order
