My first and only encounter with a towing company taught me the regulations and pricing set by the Public Utilities Commission (PUC) are extremely friendly to the towing industry. Citizens who are victimized by companies that take advantage of the favorable regulatory system have very little rights and virtually no method to remedy an abuse. Okay, so their fees are a bit high. But if Colorado is like many states, had you waited until the next day to avoid the $66 after hours fee you probably would have been hit with a storage fee of anywhere from $50-$100. So it was likely in your best interest to pick it up that night.
Should they be sitting in that parking lot? Not really but unless the state government posts no parking/ trespassing signs or sends them a C&D, I doubt they'll stop.
Some companies may not allow the driver to transport people to the lot. They just have to get a ride over there. Sucks? Yeah but life does that sometimes.
They had signs, albeit hard to see, about the towing. They might have standing permission from the lot's owner, don't know your state's regs on such things, to tow.
Oh wait... YOU DIDN'T PAY! It's not in the driver's, or his employer's, interests if they see you walking off without paying to remind you. They have no duty to do so. Furthermore, how do they know you forgot and you're not just saying screw 'em I'm not paying?
