In 2007 I entered a preliminary agreement with Mr. Mark Hardy-Executive Vice-President Europe Playpower inc. As per our preliminary agreement a few months later Mr. Billy Joyce-Director of International Sales visited me to discuss further our involvement(may & June 2008) with Miracle Recreation Equipment Company.

After seeing the opportunities in our market he agreed to our exclusivity in our territory. We took him to contractors firms, architect firms, recreation parks and visited City Officials.  Everything went well and we made our first small sale. The problem started when we made our bigger sale for a total of $158,000.00.

Miracle Recreation Equipment Company sold the equipment directly to the contractor(our customer) and refuses to acknowledge it is our sale. Refuses to pay our earned commission of approximatly today $52,000.00. After 5 months, when I finally talked to Billy Joyce he told me "he didn't know it was my sale". 

A few months earlier he wrote to me " I see from emails to Kim Parker(Director of International Sales Service-my direct contact) that you are working in a few projects for the past months, could you give me the status of this projects". I sent him the status of some of the projects and also mentioned I was working on other (smaller) projects as well.

A month before the sale, Kim Parker-Director of International Sales Service referred my company to another aqua park equipment manufacturer who wrote to me "Your information was given to me by Kim Parker of Miracle Recreation . Kim Parker speaks highly of your company so I am looking for the opportunity to discuss the possibility of representing our products in Poland". and "We are seeking qualified sales representatives to actively sell and promote our products and hope to speak with you further regarding this matter".

At the time of the sale another company contacted Kim Parker for information in regards to a project I was working on and Kim Parker wrote to him to contact "the" Miracle Recreation Equipment Company sale rep." directly and gave him my contact information; company name, company address, tel. nr. email address and contact person.

I have proof this is my sale and I have contacted Miracle Recreation Equipment Company several times in regards to this sale but they have not answered to any of my correspondence, and refuses to acknowledge this is my sale, refuses to pay my due commission of $52,000.00.

They keep doing everything in their power to distance themselves from me. Right after the sale they took my contact information from their website and replace it with the information of the contractor that bought the equipment. When I asked Billy Joyce about the projects I have placed with Miracle Equipment her wrote back to me "we will honor those projects once they are confirmed" one of those projects just came up and now they refused to sale me the equipment.

As you can see they do not honer neither their word or their written commitments. They responded to a BBB complaint but deny facts that I have indisputable evidence about.

This is simply bad and decptive business practice. Miracle Recreation Equipment Company needs to resolve this breach of contract issue and come to a financial settlement.

This is a warning to all International Sales Representative, this could happen to you. Make sure you do sigh formal contracts and make sure all litigation matters are done in your country, especially if you are the party responsible for marketing costs.
