Brad Powell, a salesman at Mitchell buick sold me a used 1997 dodge ram quad cab 2500 4X4. He constantly reassured me that the truck was in excellent condition, with no problems. I purchased an extended warranty service contract with the truck...the only way I would buy it.

I asked many questions, specifically " how's the transmission"? "was it ever towed with"? "Was the oils and fliuds changed"? He told me there were "several" new parts that cost the dealership well over 3,000....they are ALL used!

Took it to my mechanic in the next town, unfortunatly AFTER I had purchased it ( stupid on my part I know) but I have terrible credit and felt this was my only option, that if they could get me financed.

At Any rate, he told me to wait at least a month before I have anything fixed, he said "if it's not broken don't try to go out and get things fixed...you're only going to wind up with more problems" Needless to say, I told him about the leaking oil, that I didn't see or notice when purchased. They want me to bring it into them so they can fix it and then I have to pay more money.

Long story short, he sold me an invalid contract. Found out it WAS in fact plowed with, witch automatically voids out the service warranty. He has told me that " you bought it AS-IS" I said, no I didn't, I purchased a warranty. He continuse to proclaim, "I signed the papers, and I knew what I was buying"

I asked him, if I could cancel my voided contract and that I wanted at least 2,000 off the financed price or he can take back the truck. He told me that "you're NOT getting any money from us, and we will NOT take back the truck"

So then I told him, that I would be incontact with them, along with the State police.

I guess I'll have to go from there, I don't have the funds to hire an attorney and take him to court.

I just Spent 2,610 for my down payment, the service contract, and paid my first 2 payments ( and my first payment isn't even due until April 15th 2005)

I am lost, pissed, and feel so betrayed.

It's people like me who get taken advantage over every day by dealerships "doing us a favor" because we don't have Triple A credit.

It's BS, if you ask me, and unfair business.

Just because someone has had credit problems in the past doens't automatically make them a dead beat.

I needed a good dependable truck, for my children and work, and I got a rust bucket!!!!

ANYONE have any good suggestions or advise?

Or legal counsel that'll do pro bono work?

I have been in this situation before. I always get my money back. Because, I am not a person to be messed with. First of all, you have to ask for your money back, service, or whatever the problem appears to be at the time. If that won't work, (chances are it won't, but you got to try), all you have to do is kindly make an appearance every day, call every day, how many times you do is up to you. Soon enough you will start to get what you want, maybe more. My suggestion, call the owner of the company dont tell them who you are, and ask them what their policy is regarding service on older vehicles. after they tell you that they have a service contract for that type, tell them yes i know i have a service contract, and explain in great detail what his salesman did to you. Furthermore, your credit past has railroaded you enough, they sold you the car. Its their problem to fix. Don't let anyone tell you differently. "in your face" is the object here that will help you out in the end

AS i recall you said quote " I have terrible credit and felt this was my only option, that if they could get me financed" in your own words. I also said i dont agree with dealerships selling vehicles that are junk but shoot its a 9 yr old vehicle. Do you expect the dealership to cover that old vehicle. If i bought that vehicle and it blew up the next day i would say o well i bought a peice of junk, but also i wouldnt finance a 9 yr old vehicle. I just said if you paid your bills and had good credit you wouldnt have to pay 17% interest or more

I am sorry, not all people have PERFECT credit...I used to before I was married. And paying my bills has nothing to do with this dealership, my bills are paid. Next time have some manners and have something better to say, or don't bother.

Yes i have a segestions, i dont agree with selling vehicles that are junk or have problems but honestly if you would of paid your bills in the first place, then you wouldnt have to finance a 1997 dodge pick-up. Think about it, its a 9 yr old vehicle.
