This ebay customer (Noemi-77) bought a pair of shoes I was selling on 1-19-17. I was contacted and asked to cancel the order. The following conversation followed:"Hello, I was hoping to cancel this order. I'm sorry to ask & to ask so late. I was in the hospital for several days so I wasn't aware I won this auction. If you are able I'm asking to cancel this order. I apologize and would greatly appreciate it if you could cancel this order. I'm so sorry for any inconvenience I maybe causing you."  "Thx for contacting me. Sorry to hear about your hospital stay. The good news is that you can still pay for the item even though a few days late, no problem, especially since your bid does constitute a biding contract per ebay rules." "I'm not sure if you got my last message so I'm just going to resend it. Once again,I'm sorry for the inconvenience........ Hello, I was hoping to cancel this order. I'm sorry to ask & to ask so late. I was in the hospital for several days so I wasn't aware I won this auction. If you are able I'm asking to cancel this order. I apologize and would greatly appreciate it if you could cancel this order. I'm so sorry for any inconvenience I maybe causing you." "I did receive your earlier message, and as I replied, take your time, it is ok if you need a little time. Better to complete the transaction, then take an ebay unpaid strike. In that you are correct." As you can see, I gave extra time for payment to be received. The order was shipped, then I receive this email on Feb, 4, 17: "Hello, I'm not sure if you mailed the other pair of shoes separately but I only received the Bobcats, the other pair (the white/green /blue) pair were not in the box, so I'm wondering if you mailed them separately. Please let me know if they were mailed separately & as soon as I get them I'll contact you that I received them." "There is some confusion. These were the only shoes for sale in this auction. Item #142245945681 is the other pair of shoes that were unsold. After checking the ad, I see where I made a mistake by including a photo of them by error. The description would have mentioned 2 pair had there have been. Sorry for any confusion. You order is correct." Next thing I know a case was filed against me by Noemi on 2-15-17. "The buyer didn't receive the item. Buyer Requested Refund."I only received the Bobcats and have yet to receive the other pair of shoes that were supposed to be part of the lot. I would like the shoes if possible, if not then a refund for atleast half the price of the lot seems fair,icluding counting the shipping costs in the overall refund amount." "I already responded to this inquiry on 2-4-17 to the buyer and explained what happened. There was a photo error, not a description error. This is an unreasonable demand and is being reported to ebay. Now after explaining a simple error on my part about 1 photo with NO description attached, Noemi responds: "I would not of paid for the item or even bid on this auction if the auction was only for the Bobcats. The Bobcats weren't in the best condition so I would of never paid that much for the item. I'm hoping you can offer me a better resolution as it isn't my fault that you listed the items wrong, &I would of never bid on the auction had I known it was just for the Bobcats. I also am not sure that you didn't change the original description in your listing, I could be wrong but when I received the Bobcats, I reread the description. Anyway I'm hoping you can work out a better solution, I was just going to let it slide but my husband tells me I'm too nice & I should not let the matter go & unfortunately have let a few things slide already on this forum. If you noticed, I do have a perfect record on here & I always try my best to stay that way. Also, the initial reason I had wanted to cancel this order was because I didn't think I would win the auction so I didn't pay much attention to the listing after I made my bid. Then I had won another auction & that's why I wanted to cancel the order, in which you did not allow me to cancel this order with you. I went ahead & paid for it because it obviously was a good deal had I got the items the way they were posted in your pictures." So now I am accused of changing the description, and Noemi admits that she never intended to purchase the item, and bid halfheartedly which is a violation of Ebay policy. "Mam, I too have a 100% feedback since Oct. 1999. I did not change the posting as charged, and common sense would dictate that the description would have included the 2nd pair of shoes if in fact they were included. Item #142245945681 was the listing for the other shoes. Why would I do that if they were for sale with the Bobcats?? Also additional photos would have been included just as all sides of the Bobcats were shown. I do not appreciate the insinuation that somehow I am defrauding you. You know that your bid is a legally binding contract per ebay rules, and you received what you bid on, even after a payment delay. I explained and apologized for the error photo that was listed, but there is no way that it would indicate that there were two items, or I would have listed that way. As I said, I have been doing this with a 100% feedback since Oct 1999." "Ofcourse, which is why the item was paid for. But you did not post the item correctly so like I said, I would of never bid on your auction had I known the items in your pictures were not part of the auction. So I obviously wasn't getting what I bid on & what you posted. Once again, an apology does not offer a resolution & I am definitely the one who was mislead per your pictures in your auction. I was obviously mislead & you've done nothing on your end to resolve this. It just goes to show what one will do to make a buck. At the end of the day, it's on you & your record, which I'm assuming Ebay will have to honor because you refuse to offer no resolution. It's not the money that matters, it's the principal, and unfortunately Ebay will have to honor it's promise to me as a customer on this forum, on your behalf. Your apology does not do anything to fix the problem. As I previously stated, I would of never bid or paid for this auction had I not thought both shoes were included as shown in your pictures. As a seller you should of made sure you posted the item correctly, the picture is the most important part of your listing & how you interpret this matter as not being such a big deal is troubling & honestly I don't see how it could of been missed. Either way you've done nothing on your part to offer a fair resolution so I will move forward with whatever action I must take. Respectively & logically speaking, you haven't sold not even near half of what I've purchased on this forum so I'm sure my feedback will be more tusted than yours. Sincerely, Noemi" Now I am not as good as she is on Ebay, and I am accused of fraud and deception, and being rude to boot. totally bogus! "I will not argue with you any longer. You do not listen to reason. I welcome Ebay review because I did nothing fraudulent. There is also the ability to ask questions before bidding. There is no solution offered to a non problem. Ebay policy quote from customer service page: "Keep in mind that each bid you make is a binding contract to buy the item if you win. A bid on eBay is considered a contract, and you're obligated to purchase the item." I will await the decision from Ebay." Next she contacts Ebay for a resolution after threatining me. "The Seller has not offered any resolution beyond an apology for posting the item incorrectly which does not offer a resolution. The seller admits to incorrectly posting the pictures wrong in their auction which lead me to believe I was bidding on 2 pairs of sneakers, not just 1 pair which were the Bobcats, the other pair was in much better condition per the pictures & I didn t even get that pair. I communicated several times with the seller who didn t offer or even counter any type of resolution beyond their apology for posting a 2nd pair of shoes in their auction. The seller reminded me that my bid was a binding contract which is why I DID pay for the auction. However, I told the seller that I would of never bid for this auction had I known I was only getting one pair of shoes & not both pairs like in the pictures presented in the auction. Therefore I feel very mislead, I paid for the item although I did not get what was presented. Furthermore the shoes that I did get were not even in the best shape, had they been in better condition or had I got both pairs of shoes, there would of been no complaint on my end. I would appreciate Ebay s assistance in getting half of the money I paid for the auction (shipping fees included ) or some type of reasonable solution beyond an apology." Since Noemi wanted something for nothing, and it was obvious that she never wanted to pay from the beginning, Ebay refunded her purchase. What Noemi dosen't know is that the decision did not count against me, nor were funds taken from my account for the refund. It was done thru ebay guarentee. I also discovered in Noemis feedback file, that I am not the first seller she has stiffed. So much for a 100% feedback. SELLERS BEWARE!!
