Complaint Description:

This complaint is in reference to a fitness memebership with National Fitness. I attempted to discontinue my membership in October 2003 because of racial conduct in the workout facility but was told that I would have to pay out my contract. Well, I refused to pay so they reported my account to collections, located at 1645 East Highway 193 Suite 100 Layton, UT 84040.

I have been trying to dispute the collection account for the past 4 years without any positive results. I contacted National Fitness in June of 2007 and told them that I would agree to pay them only if they would remove the item from my TransUnion credit file.

They agreed to have the account removed if I paid $444.68, so I paid them. They said they would issue a letter to me and also to TransUnion stating that my account has been resolved and should be permanently removed from my credit file . Well, they never had the item removed from my credit file but they have my money.

The company lied to me just to get me to pay the debt. In order to get me to pay the account they were entirely unethical in their collection practices. I spoke to a representative on 10-15-07 named Shauntel at (801) 574-7234 ext.1910 and she informed me that I was given the wrong information by the representatives. She said that letters were mailed to me which I never received. This is the only negative item on my credit report.

The company was negligent in reporting the item to my credit file and they were unethical in informing me that it would be removed if paid. I have attempted to dispute this account with TransUnion directly on several different occasions but National Fitness is stating the account is accurate. I have also filed a complaint with the Federal Trade Commission and the Better Business Bureau for unethical collection practices.

This is the only negative mark against my credit. The account shows as paid but that was not our agreement. Our verbal agreement was that if I paid them they would have the item removed completely. I am highly upset and I am preparing to file suit against the company.
