I joined Better Bodies Fitness in Aurora, Colorado in January of 2008. In November of 2008 I moved about 10 miles away to Denver. I called National Fitness Financial(the collection agency for Better Bodies) and was told I could cancel my membership if I paid a cancelation fee of $100.

I sent the check along with a letter stating what the money was for and my membership number and they cashed the check. Meanwhile, a representative of National Fitness called and said I needed to send documentation of my move proving that I moved. I said that I was not told about any of this. I was told to send $100 and that would take care of everything.

The representative then asked me how far away I moved. So I gave her my new address and she said that I had not moved far enough away. I needed to move at least 25 miles away for them to void my contract.

I then proceeded to explain that since they cashed the check they had agreed to void the contract since I had stated what the purpose of the check was. I do not send checks to them ever. I am set up on an automatic withdrawal from my checking account. So I am waiting to see if they continue debiting my account. If they do I am thinking of taking it to small claims court because I am furious.

Hi I'm an ex-employee of this company and before I say anything let me first start off with that I have no love for this company. Overall they are not a bad company. The main thing that you have to remember is they are hired by the gym to enforce the contract. They can not break, change, and/or modify any portion of the contract. With this in mind anything that your contract has on it they have to honor. If you have a copy of your contract I recommed you read the back side of it. If you don't call NFFS (National Fitness) and request a copy. On the back it will have all of the reason why you can cancle your membership early. Everything back there though will require you to prove that you meet the criteria for that option. The one option that I do not recommend you use though is the doctors note (unless of course you have a chronic illness). They made it so you have to get thier form filled out which most doctors don't like to do because it states on there that they (the doctor) can be sued if the information is incorrect. Also I remember one person actually was arrested for fraud. If you find something that you can use to cancle call NFFS and tell them that you meet that criteria and make sure you send them exactly what they tell you to send in (i.e phone bill is not the same as cell phone bill). Unfortuantly these contracts are very well written to protect the health club more then the member. So you might be stuck paying your membership. If you can not get out of your contract early make sure that you call NFFS and verify that you are going to cancle at the end of your contract and not go into a month to month contract. If you are going to go into the month to month make sure you follow their instruction on how to stop that and that you follow up with them to make sure that you are going to be canceled. I know that many people think "This is only a gym membership" but you really should look at it more as a loan. If it goes unpaid it can and probably will go against you on your credit score. I took so many calls in my 2 years of service with them with people begging me to take this off their credit so they can by a house, car, etc.. and then find out what would have cost them $500 several months/years ago it now is over $1000. Also If you have return/late fee's NFFS can write those off 100% and they usually will but once you go to collection (not late payments dept) they generally get harder to taken off. Good luck with this.
