I contacted National Recovery Network in January, 2009 to recovery my vehicle. Immediately after assigning the case to NRN, I received an email stating that they have a No Recovery, No Fee policy. The email also stated "if our efforts are not sufficient wewill not be paid". After several weeks passed with no updates posted on the website, I called NRN to ask for an update. I was told that an update would be posted by one of the investigators.

However, no update was posted. I placed 2 subsequent calls requesting updates and was told the same. However, not 1 single update was ever posted on the website. I called NRN and asked them to close the case. I decided to hire someone else to handle the case, since NRN did nothing. I immediately received an invoice for $1,170.50; then 2 follow-up calls from NRN asking if I received the invoice. Funny how NRN can communicate promptly and aggressively when they want money, but no communication while they are supposedly handling your case. I called NRN to inform them that I received the invoice. I was asked when I would be sending payment. I informed the rep (Debbie) that I would not be paying anything since NRN did nothing and they have a No Recovery, No Fee policy, as stated in their email. I retained a copy of the email for legal purposes.

Ms. Leah Myers, As to your allegations National Recovery Network Artifice to Commit Fraud Scam etc. Ms. Leah Myers, in law, Defamation of character is the communication of a statement that makes a claim, expressly stated or implied to be factual, that may give an individual, business, product, group, government or nation a negative image. Most jurisdictions allow legal actions, civil and/or criminal, to deter various kinds of defamation and retaliate against groundless criticism. You and your husband Philip hired our company in Dec. 16, 2008 to recover a 2004 Jeep Grand Cherokee from Patricia Hulse due to her default on a personal loan provided to her by your husband. Prior to submitting the assignment, Philip had to accept our Terms and Conditions before clicking on the I Agree button. Client agrees and understands that each recovery is unique and NRN LLC's base fee DOES NOT INCLUDE hardcore skips, investigation, fraud, identity theft, criminal enterprise, national database charges, etc., and that NRN LLC's final invoice is based upon the degree of difficulty in the recovery and the means necessary to recover your particular collateral. NRN LLC's base fee is just that, a base fee, and the level of difficulty and expenses encountered engaging in the recovery will result in an increase in the final charge to Client. On Feb. 23, 2009, Leah you sent over a request which stated, I, Leah Myers and my husband Philip Myers are no longer requesting services from National Recovery. The vehicle in questions has been recovered. Upon being notified of the cancellation, the case file is sent to our billing department and billed as a Positive Resolution per our Terms and Conditions below: I further agree that by submitting this form, I affirm my legal entitlement to possession of the above described collateral. It is NRN LLC's assumption and assertion that Client is contracting with NRN LLC to legally secure property, which Client is legally entitled to, therefore it is agreed by both parties that this contract will be in full effect for a minimum of one hundred and twenty (120) days. Any attempted cancellation of this contract will be considered a positive resolution and you will be billed at a base rate plus any additional expenses and charges, if incurred. You were billed accordingly. As to your allegation hiring collection Attorneys yes, we do have collection attorneys to handle cases such as yours when a client fails to pay. As to your allegation regarding Civil lawsuits in Maricopa County Courts, many of which they have lost Leah, this is an untruth. As to your other allegations, Leah because you are upset over having to pay (a reduced settlement) as per the signed written contract you are maliciously attempting to defame the characters of our employees by spreading untruths. National Recovery Network LLC recovers nearly 25,000 pieces of collateral a year and the difficulty varies in each case. I point out, Leah that your husband Philip made a conscious choice to sign up with our company, we were hired to do a service, we were actively working towards recovering your vehicle when you took matters into your own hands involving other entities. Though we are happy you have possession of your vehicle, we did incur expenses and you were billed accordingly. Our terms and conditions are clearly written and easily accessible and can be viewed on our website nationalrecoverynetwork.com. In closing, it certainly is not our goal to have economic gain from a clients' cancellation, the only reason we have a clause in our contract in place is to avoid situations of clients wasting our Investigators valuable time in assisting sincere clients with their recoveries. Our records indicate this account was settled for a reduced amount of $499.00. and we have closed it as Paid in Full. Our office retains Corporate Attorneys for situations such as yours in the threat of a lawsuit.

#5REBUTTAL Owner of company

Wed, April 01, 2009

On or about January 13, 2009, you Ms. A.M. Beth contacted National Recovery Network LLC to obtain information regarding the recovery of your 2000 Mercedes SLK230. You completed our online assignment form. I would like to state Beth that you were required to accept the terms within this contract prior to submitting your assignment. Our website assignment form is set up in such that if you did not click on the box By submitting this electronic form with Client's electronic signature, Client agrees to all of the above terms and conditions. your assignment would not have processed. Do you always sign contracts without reading them? NRN offers a No Recovery, No Fee Policy, however the client must allow us reasonable time to conduct our investigation and determine a place and time the property in question is most vulnerable. Beth cancelled prior to the expiration of the signed contract. I further agree that by submitting this form, I affirm my legal entitlement to possession of the above described collateral. It is NRN LLCs assumption and assertion that Client is contracting with NRN LLC to legally secure property, which Client is legally entitled to, therefore it is agreed by both parties that this contract will be in full effect for a minimum of one hundred and twenty (120) days. Any attempted cancellation of this contract will be considered a positive resolution and you will be billed at a base rate plus any additional expenses and charges, if incurred. As to your complaint regarding the updates, In researching your allegations regarding the updates, NRN recognizes that our office was very limited on the information we felt suitable for online viewing, keep in mind there are third party information laws we must adhere to, also we limit our information due to client interference with our investigation, clients often will unintentionally hinder an investigation by repeating some or all of what they learn from an update, to safeguard an investigation it is imperative that the client knows next to nothing that has transpired in an investigation, until its conclusion, just because updates are not listed online does not mean that our Investigator and Field Agent were not actively working your case. In closing, again I point out our Terms and Conditions Any attempted cancellation of this contract will be considered a positive resolution and you will be billed at a base rate plus any additional expenses and charges, if incurred. Beth you were billed accordingly. However, our General Manager did have this comment, National Recovery Network LLC and the owner Mr. St. Marie are extremely disappointed that we were not able to recover your vehicle. The owner Mr. St. Marie personally thrives for perfection and has demanded a complete internal investigation into this matter to determine what or if any part of our Investigation could have been handled differently, if any leads were overlooked, or if the Tow Company was just at the right place at the right time. At this time, a decision has been made to not pursue collections against you in this matter and it certainly is not our goal to have economic gain from a clients cancellation, the only reason we have a clause in our contract in place is to avoid situations of clients wasting our Investigators valuable time in assisting sincere clients with their recoveries.
