Came home from work today to a "Summons and Notice of Claim" filed 12-10 by NCO vs me.

"This cause has been assigned for hearing on January 7, 2008 @ 11 am. You must appear personally or by your Attorney to the Court or the Plaintiff may be given deault judgement against you." "The Plaintiff's Claim is for (circle one)...nothing noted. A brief statement of the nature of the Plaintiff's claim against you is as follows: Money owed on delinquent account issued by Capital One. The plaintiff demands judgement against the defendant for $1,442.21, plus interest from _______, 20_____, at the rate of ____%, and the costs of this action. Service of summons by Sheriff. Attorney for the Plaintiff Kliment P. Mitreski #25021-45 Telephone 866-269-9858.

Being completely confused by all of this, I ran my credit. I found these three:

Capital One; account type-revolving; date opened 1-2001; balance $0; Date reported 5-2007; Past due $0; Account status -Charge Off.

Capital One; account type-revolving; date opened n/a; Balance $1,122; date reported 10-2007; Past Due $1,122; Account status-Charge Off.

NCO FIN/22; account type-open; date opened n/a; balance $1,453; date reported 9-2007; Past Due $1,453; account status (blank).

I would appreciate any help or experienced advice in this matter...

You need to File a "Answer to the Complaint" to protect your rights!

If you search anywhere on the web you will find thousands upon thousands of horror stories about NCO including but not limited to Lawsuits filed against them and fines less than a year ago sanctioned against them by the Attorney General for PA. They have a established a pattern and history over a long period of time. You can find for most jurisdictions the forms needed to assist you in filing the Answer to Complaint at the web site of the Court where the case was filed. If these forms are not available at that court's web site then go to the court who's address is listed (or should be) on the Summons and go to the Clerk's Office and Request Information and.or Forms Package for a Answer to Complaint. Further, if you qualify you might want to also file a Application for Fee Waiver" along with your Answer. This will help you with the Court's Filing Fee that is often required to file a Answer to Complaint. If you fail to answer they can get a Default Judgment against you and then turn that Default Judgment into a Abstract Judgment taking them from a unsecured position to a secured and then start attaching. Protect your rights, don' sit on your hands! You can also file a Dispute with the Major Credit Reporting Agencies. You can find instructions and Samples on how to do that all over the Web. Remember to send correspondence by Certified Mail, Return Receipt Requested. They have 30 days to prove it or remove it!
