To whom it may concern,

I am writing this letter on behalf of myself and my family. I have had nothing but bad faith and luck with my mortgage lender and title company, since they funded me a HALOC loan for $20,000 in December of 2005. Now I' am running out of time and options or resources. Please help me. In November 2005 Great Southwest Mortgage had called me and asked if I was ready to pull some equity out of my home for the holidays. Of course I would love to give my children a good Christmas after my husband and I had split up.

I had my house built in July 2003. Anyhow, My children wasn't going to have a good Christmas that year due to me being single and when I received that phone call, my hopes were lifted and so was my depression for the holidays. My house was built of only 115,000 and within 2 ? years the equity went up to 275,000. So I said sure would love to be caught up in life, so I gave him my information on the phone and he said he would get back to me with good news. I was excited and had hopes.

So I finally had the sprits to tell my children to write Santa Clause a letter of what they wanted for Christmas. So finally Scott from Great Southwest mortgage called back and said that he had a lender that would fund me but it would be about 12% on a 20,000 loan. That was ok for me cause it would be worth it to see the look on my children's face that morning opening up gifts. So I said ok lets do it!!! So he had me gather all of my papers and sent him everything that he had needed to complete for the signing of the docs.

On December 21 the notary came to my house with loans documents for me to sign. She had stated that she worked for the title company's contact for my loan (Cheri Henshaw's) brother's title company, but helped Cheri out after hours. So while we were signing the loan docs, I was asking her what al the numbers were and which one I would get and the total and total amount for me to pay for the loan and ect?ect?ect?.! She stated she couldn't answer me and that the truth and lending and settlement statement and good faith statement will always be different . And the final papers that I was signing at that moment, would be the correct amount. So I kept signing , page by page, I had noticed that I will be paying 24% on the loan and that I will be paying about $10,000 to-do the loan. I couldn't believe this , my husband was always the reader of the fine print and I never really understood the concept of all of this stuff.

Well the loan was done at the end of the day December 21st 2oo5, I had just made it for Christmas gift shopping for the children. She had stated after my 3 days to cancel the money would be direct deposited into my bank account which I had wrote her a check for to do. Well a week went by no money, checks from account were wrote for gifts, and bills. So I called the title company First American Title , and taked to Cheri Hanshaw, I had stated that the money was not in my account and she had said that the money was lost in route somewhere and she would have to find it. Finally the money was put in to the account on decmeber 28th in the amount of $8090 I do believe. So I did with it like I had planed to do.

A couple of weeks went by and my boss had told me I had several of calls from a title company saying that I took money from them and I had better return her call (Cheri Hanshaw) or she was going to get her attorney involved. Numerous of times I was told by my boss that this lady said I stole money form her company. Well dealing with my job title I had dealing with money , running the office and book work at my job. My boss said that he could not have me working for him if I was taking money from my lender, and if so I would steal from him too. He cant have no doubts in his employees, so he had to let me go. So then I go home and my daughter was crying saying that this lady Cheri was going to sue us and take our home because I stole from her. So I had enough and called my lender, Michelle at Network funding and asked what is this about. She stated that Cheri from the title company had instructions in the docs to do as they asked and they said it was stated very clearly what to do. And the problem lies between then and the title company. And not to worry about nothing. It was my money anyways , but Cheri was supposed to hold back 2500 in a HALOC account until I made a payment on time and then I could draw from that when needed. So I had called Cheri and she was rude and I jumped back at her on the phone and she hung up on me, so I had wrote her boss and her to tell them what I was told. I have all of the emails from them and my loan docs.So I made a payment in feb2006 in the amount of I think $350.00 so I get a call from Michelle and I had told her I lost my job and I spent the money and I couldn't get it back, So Michelle talked to her boss and they added 2500 more to my loan. Then emailed me my new loan docs I had their copy notarized and sent it back to them over night. So now we are in the first week of march 2005.

I had noticed that my loan docs said that Countywide homes bought my loan in Feb2006 and to start making payments to them as of Feb. 1st.2006 . So I did, in March. Then in April my house caught on fire and I hadn't had enough time to get the payment in fir April to countrywide. I figured 2 weeks late wouldn't hurt. And they would understand since I had the fire. But then on April 25th I received a letter of default from a David Bonfoiolo stating that my house was going to be sold on August 4th 2006. That I had to come up with 4,300 which includes fees and a late payment of $333.00. Well I was down and out and I already paid for the month of March. Why or how should I pay it again adding on 2,000. But I didn't want to lose my home. Told him I would get back to him.

I had called Network Funding and told them that I lost my docs in the fire and that I would like to have a copy of my first docs for my personal records. They emailed me some loan documents that were kind of like the original ones, but different with names and numbers. Little do they know I still have the first ones and second ones on me. I really don't think that I should have to pay all of this money. If country wide does not own my lone then they started the foreclosure on my house only 10 days after my due date. I had told them about countrywide and they said it was a computer glitch, and not their problem. Now the reason stated in the papers they sent me with my copy of fake loan papers said that I am late on my taxes. So that is the reason why. But they paid my taxes back in December 2005. What do I do? No one seems to be able to help me with anything. Can someone help me save my home? And do to these companies what needes to be done? I am getting so sick from all of this, I cant bare to lose my health , home and children all at the same time.

after all of that, i had to file chapter 7, david bonfigilio went to federal court and said he would recind the loan, so the judge said ok, then 5 days later he auction my house for 28,000.00 when the loan was brought down to 8,000. he took the money and ran. and my family was force to vacate in 3 days. some how network funding recorded themselfs 1st on my loan, they got rid of my 1st loan for 216,000.00. i think they have in side help. lets get together and get these scum. please contact me (((ROR redacted))) CLICK here to see why Rip-off Report, as a matter of policy, deleted either a phone number, link or e-mail address from this Report.
