My sister was hounded repeatedly by this agency claiming to be debt collectors. When I did call them yesterday, I was connected to "Jane Smith", who had a very heavy accent, who verified the last 4 of my social and the year only of my birth against her records, and then stated that I had a delinquent payday loan from 2012.

She continued that they were ready to file a "Petition for Summons and Garnishment of Wages"...and then went on to list 4 criminal charges that would be on there, including Internet Fraud, Check Fraud, Intent to Commit Theft...

Upon asking who the originator of the loan was, gave Vista Holdings LLC as the originator - but could not tell me which website. I asked for confirmation of the loan in writing. She stated that she was a "Abritration Agent"...and that only Vista had that information and the only thing Vista would mail would be the Summons. The FDCPA requires followup by mail w/in 5 days of initial phone contact.

I have never been served a Summons, so I know I am not in arbitration. I've also never heard of an Arbitration Agent.

She stated that that the original payday loan of $350 was made on 3/12/12, and went delinquent on 08/05/12. California law caps payday loans at $255. No payday loan last 5 months. She also told me that my address at the time of the loan was my current one, when I've only been here since 05/14.

I told her that I needed some time to think, but would call her back to resolve this week - as I was scared, nervous, and panicked at the time. As I begin to think about it...the FDCPA violations started becoming more obvious - as well the lack of any actual verifiable information on the company.

I called back a little later to precisely get the name, as the first lady had a thick accent and seemed to hurry through it. I thought it was National Recovery Associates. I got the next clerk to repeat it to me slowly which is when I got Northwest Recovery Associates, and then thanked him and hung up. I almost immediately got a call back from the other 844 number, which was not the one I called.

I have contacted all of the payday loan services that I used when I was in a bit spot awhile back - none have accounts for me, and the one that did is one I am now working with and in no way matches the information given. I also pulled my credit report this afternoon, and can find no match to the information given.

As I am supposed to be calling back to set up "payments", I will be trying to get a mailing address or website information from them. I also realize now that the conversation did not begin with her stating that she was a collection agent, and that this was for the purposes of collecting a debt.

Thankfully, I've had a chance now to read the FDCPA and the CFDCPA (California's mirrors the Fed's, but also applies to creditors as well as debt collectors. I have seen elsewhere in reports that they may claim to be process servers...but I am aware of zero legal processes that may be done over the phone.
