First, if they say it was a "Forclosure", what documentation is there to verify this fact? This information would be available in your Credit Reports, which would only cost $9 per application. You might even qualify for a free one, for the year, if you suspect documentation has been potentially falsified. You have the right to dispute this claim through TransUnion, according to the Fair Credit Reporting Act. If you have the time, access www.ftc.gov, and the information is there. I also want you to call this number: 1-877-FTC-HELP. Ask them to refer you to the specific documentation you will need. Disputing the claim might take some time, but if you have the necessary evidence, show it to your Loan Officer, of have the FTC direct you to the proper authorities to protect and validate your documentation. Really, the Courts might be the only ones to require the originals, anyone else should just get photocopies. Even while you call, go through all of your documents. If you know for a fact, this was a "Repossesion" and not a "Forclosure", you should have some type of "Notice" documenting this legal procedure. A Repossesion would appear differently. Your Loan Officer can make that determination, with you. What papers were served when this happened? Check your Bankruptcy Records. Those Records would attain valuable information, as to your specific unpaid debt. Look for the Repossesion Information, and NOTE that area of the documentation. Review your Tax Records. You might find something there, depending on when the Bankruptcy was filed, and the Repossesion took place. IF they are illegaly reporting information, there are penatlies. It is true, they are not obligated to sign any form or contract. But, if you have the evidence, there are consequences for that refusal. They will have to pay a price.
