BUYER BEWARE!

Anyone who is about to have ANY dealings with Bert Whalen, Oceanpoint Investments, Oceanpointe Investments and Property Management (hencforth OC) or any of their agents beware.

I own a small SFR in Indianapolis, IN for which I contracted Bert Whalen, Natalie Bastain and Oceanpoint Investments and Property Management to manage. There have been numerous issues with them from the beginning. My initial lease with the current tenants was for $725/ month rent, which OC collected for a while. Then, without my knowledge or consent, the rents with the same tenants were dropped to $650/month. When I asked, OC why this was so, they became irate and stated that was "the going rate". When I asked for a copy of the lease, they told me that I was not entitled to this information because "the tenants have the right to privacy". So I was not "allowed" to know who was living in my property. In addition, I was told that because I wanted paper checks and would not access to my bank account, I was not allowed access to the property management software where I could see how my property profile and accounting.

In September 2017, they stopped sending any rent checks at all. I left numerous voice messages on the ten different telephone numbers that I was supplied, sent faxes, emails and even snail mail asking where rents were. I received no response from anyone there in any fashion whatsoever. At the end of October 2017, I received an email with an "invoice" stating that the property is vacant. When I attempted to find out if/when they would re-rent the property, I received no response again. The beginning of November, in order to secure the property, I decided to have a locksmith go to house and change the locks where the locksmith found the current tenants living and paying rent in a timely fashion. Every attempt to reach anyone at Oceanpoint has been met with silence.

In late November, I sent OC a certified letter demanding that they send rents and severing the contract with them as they were in breach of contract by committing fraud. Again, I received no response.

In early December, I contacted with tenants explaining I was the legal owner of property and their landlord and rents should come to me, at which point they told me that OC showed them papers stating that they, Oceanpoint, owned the property and tenants should , under no circumstance, speak with me. At this point I contacted an attorney. Even after the attorney sent a cease demand, OC threatened the tenants would be "thrown on the street" if they didn't pay several months of rent in advance. The attorney also explained that OC has been to Town Hall on numerous occassions in attempts to have my property redeeded under their name. This expalins why  for the past year, OC has harrassed me to give them my social security number, company EIN and bank account numbers under the guise of sending my rents via wire. In other words, they tried to steal my property from me which was why they needed the information.

Finally, the actual property manager, Marsha Manuel and her husband Carlos, made shoddy repairs, including electrical and plumbing...neither of which Marsha or Carlos are licensed to do. Marsha also gave the tenant "permission" (without my consent or knowledge) to make structural changes to the property including moving walls and removing stairs.

I have been told that the Attorney General's Office for the state has had numerous complaints about OC and has not opened any investigation into their business dealings. I also contacted the Realtor Board, who stated that there have been numerous complaints against Bert Whalen, Britany Helper and Natalie Bastain for improper real estate practices however, no licenses have been suspended as yet.

Apparently, Bert Whalen has removed all possessions from his name in order to further cheat anyone who attempts to sue him out any remuneration.

I have also been told by my attorney that there are several arrest warrants for Bert Whalen, yet he's still a free man.

SEC laws are also being violated by Oceanpoint Investments who works with numerous high net worth investors, neither Bert Whalen nor OC properly accredits these investors. To my knowledge, the SEC has not investigated yet.

Bert Whalen has many foreign investors for whom he is the agent. The companies for these investors are improperly set up and no U.S. taxes are paid. He has defrauded me out of my rents, but he is also defrauding the United States out of income taxes from foreign investors.

Please use my loss as your warning:  OVER THIS PAST YEAR, EVERY PERSON THAT I'VE SPOKEN WITH AT OCEANPONT IS "IN" ON THE FRAUD AND ARE HORRIFIC "PEOPLE"...THEY ARE RUDE, NASTY, FOWL MOUTHED AND DISHONEST. THIS COMPANY AND THESE PEOPLE ARE PARASITES.

Bert Whalen sold me 8 homes last June that were to be fully rehab'd by closing.  Closing came and nothing done, have a signed promise that for the first year he will take care of any problems or issues and finish the rehab.

There were issues in every home, plumbing, electrical, leaks, on and on....

Renters paid him the first few months and I never got reimbursed to the tune of $4000.00.

Everytime I contacted him to fix something, he argued it wasn't like that, have never had so many issues, and never fixed anything the right way.

Finally gave up and hired out other contractors to fix problems, about $2000.00 between the 6 homes.

6 months later, I still had 2 homes not habitable, no electricty, not finished.  Found contractors to finish them to the tune of $12.000.00

Just had someone evicted, someone he placed, and now have $3500.00 worth of fixing up to do on that house.

The only reason I bought from him was because 2 other people I know said 'he was a good guy'.   They are now sorry too...  he has done the same thing to them...  Wish I went with my instincts and with the info I saw on the internet and not bought his horrible, unfinished, slapped together homes.

Thought of taking him to small claims, but he has many claims against him already, that I would probably be wasting my time.

Since you are not responding via email or phone, may be you can read this and respond. You know that you stole money from many of us with the promises of a rehab property. So if there is only a mistake, call, email, but show up. I am still giving you the chance to respond to your actions. 

There are many victims of this man!!

Bert feel free to make contact with me if you truly feel that OP has done nothing wromg. I am out a couple months rent, move out fees for a tenant that never moved along with a cleanup fee that was never done. No contact except for an inteligable commnet from [email protected]. Calls went to a "voicmailbox full" message. Emails to Natlie Bastin and Morris Invest went unanswered also. If truly legit, what is going on?

The person writing this was Anna Guarna who is completely misleading .  our company took care of Anna after she was shafted by another real estate company and rented her house out and took care of all of the problems regarding the house her tenants paid timely due to the fact that she was the only client we had that would only receive a paper check her payments were sometimes delayed. After being in business 22 years I would never try to retitle a property into my name nor would I even know how to.  Managing over 1500 homes I would never select one person to try to retitle the property to myself. She’s obviously very confused and the tenets after she engage them directly must’ve confuse sure we never ever tried to give them a rent to buy contract or anything we strictly manage properties we don’t do rent to buys and we definitely have never tried to retitle a property. Our attorneys are looking into this and if need be will have to file a suit against her if this arises again.

I am actually a previous tenant that has gone through horrible issues with them and I wanted to see if you might would have someone I can speak to as well. Please if you can help me in any way I would like to speak to you more. thank you
