I am writing this because me and my family have become victims of Ocwen and there fraudulant business practices. I have been fighting with this organization since they aquired my loan account in January of 2006.

At first they were harrassing me about a "missing" payment that was sent to my original mortgage company 1st Consolidated Mortgage. I have sent proof via US mail several times each time this was dismissed as an error and the correction would reflect on my next statement. This did not happen.

I have also sent proof of Homeowners Insurance several times and each statement I received reflected the $2400.00 they were trying to add to my escrow account. Actually the "3rd notice to add insurance" said it would be an additional $2400.00 added to my loan and adjusted accordingly, this figure should never have been added and was disputed by myself every time I received a statement and saw this ridiculous amount on it.

The amount was also never $2400.00 and ever time I would speak to a representative at any one of the numerous 1-800, 1-877, or 1-888 numbers I was directed to call no one could give me a definative answer regarding the charge or how much it was supposed to be but I was always given the excuse that it was an error on their part and it would be credited and my next account statement would reflect this. I was also instructed to re-send my proof of insurance which I did every time I spoke with someone. This has gone on since February of 2006.

Finally, the last straw. On my February 2006 statement there was a note in the important messages section notifying me on how I could save $90977.91 in interest and reduce 8 years and 5 months off my mortgage. There was an enrollmetn form enclosed with my regular statement and I called the 1-888 number on it to inquire about this it was some sort of bi-weekly payment enrollment plan for the low cost of $195.00 offer expiring on May 15,2006. Needless to say I enrolled.

To make an obviously long story short, I sent in my bi-weekly payments via moneygram. In August of 2006 my husband came home from work to eat lunch and found a note on the door from a realtor stating that he was employed by Ocwen and that he had instructions to sell our home and offer us $1000.00 to move out in 2 weeks. I spoek with im and told him that he was not selling my home and that I was not moving out in 2 weeks etc.

I called Ocwen and again I was assured that there was not a problem that this was an error and they would contact the REO Department and resolve this matter immediately, they did not reflect me being behind on any payments and I never heard from the realtor again. I was also instructed to call back the next week to confirm the issue had been resolved.

I have been calling every week since September and every week I have been instructed to call back the next week. I have since been arguing with them regarding insurance and that "missing payment". This morning when my husband was leaving for work there was an evicition notice taped on my front door fromt he Harris County Constables Office. We are to appear in court (to be told I presume that we don't have a home anymore)

i ahve been on the phone with Ocwen snce this morning. I have been transfered to so many people I don't think I am getting actual names anymore. I was informed that my Principal and Interest Loan was Forclosed on in September and that every payment I have made was received applied to a "suspension" account this set my loan in default but some how $600.00 was applied to that same account on August 14, 2006.

The home was put up for sale and was re-purchased by Ocwen with NO NOTIFICATION to me via US mail, certified mail, attorney, etc. I was then notfied that they didn't want me to lose my home an "e-mail" was being sent and a response was needed to be received from the Lawyers regarding the resending of the forclosure and once again I was instructed to call back this PM at 4 or 5.

I did some investigating of my own and contacted to Law Firm on the Eviction Citation I spoke with a secretary or paralegal and she informed that they had received no notfication from Ocwen to resend teh forclosure that it wwould be an unusual request but she also said that they are employed by the client and have to do what the client wants so if they are planning on resending the forclosure Brown and Shapiro will be more than happy to oblige them. I also gave her the name of the loan resolution Manager who is supposed tob e communicating with them and she said she had never heard of this individual.

I then called Ocwen back and ironically spoke with the same Loan Resolution Agent I had spoken with this AM. Told him that the Law Office had never heard of his Manager and that he was a liar. He then put me on hold to talk to his "Manager" - Did I mention the managers name is supposed to be Eddie Breadlove? Is that a real name? He then said I was mis-informed and that the e-mail that they were waiting on a response from was directed to an internal department (REO) and a girl named Jessica was supposed to be handling this. I was then apologized to profusely and instructed not to leave the property!! But always to call back this time not next week but this afternoon at around 4 or 5.

I am waiting to call them back for what i don't know. I guess I am hoping that they will work with me and not put my entire family out into the street right before the holidays.

Home for the holidays but waiting 4 the other "shoe" to drop

In my original report I gave a play by play of my dealings with Ocwen. I left off waiting for 4 o'clock to roll around so I could call them back - again!! So I did. I sopke with a representative and was given some wonderful news. The forclosure is resended and the eviction STOPPED on my home. I even called their Law Firm to confirm this and I was assured by a Secretary or Paralegal (not sure of her title) that I was not being evicted from my home!!!! I can't even express what a relief this news is since the Holidays are around the corner and our daughter's one year birthday is on November 15th. The only thing that makes me weary is that I was informed that the suspended payments will be applied accordingly and that I will have to be set up on a Forbearance Agreement - the terms were negotiated with me and the payments date decided, I will be receiving my Forbearance Aggreement electronically by Tuesday of next week. I will be making my down payment on November 3 and skip December and resume my mortgage payments starting January 2007. This is kind of scarey but I don't ahve a choice but to go with it. Any suggestions on what to do from here with regards to refinancing with another company or just selling my home? Thank you.
